    1. Comment: King Dethroned - The House GOP leadership decided

    against offering the chairmanship of the House Immigration

    Subcommittee to Steve King, a practitioner of over-the-top anti-

    immigration rhetoric. Instead, the gavel went to Elton Gallegly,

    who is equally anti-immigration, but who shuns the limelight and

    operates quietly. In an interview with the National Journal,

    Mr. King blamed Speaker Boehner for this turn of events, saying

    "John Boehner isn't very aggressive on immigration" (note: Mr.

    King was deprived of his subcommittee gavel before news broke

    about the shooting of Rep. Giffords). We commend the House GOP

    leadership for recognizing that tone matters and hope that

    Republican leaders will seek to silence anti-immigration fanatics

    within the GOP. This is yet another sign that the House

    Republican majority will likely move on immigration legislation

    in the 112th congress, with a bill with a mix of mandatory E-

    Verify plus employment immigration benefits. Such a bill would

    defuse criticism of Republicans as anti-immigration, and split

    the Democrats, who are traditionally against business

    immigration. DREAM might well be a sweetener offered with such a

    bill, especially if the anti-immigration faction of the GOP

    absolutely refuses to support the Republican leadership's

    immigration bill, consequently creating the need for Democratic

    votes, and therefore, of a sweetener. In any event, despite fears

    that the status quo would reign on immigration, the 112th

    Congress is off to a good start. We will be following Congress

    closely, and will keep our readers informed on the latest

    developments, stay tuned.

    1. Comment: The ACWIA Man Returns - The man who negotiated ACWIA

    with then Sen. Spencer Abraham (R-MI) who was then the Chair of

    the Immigration Subcommittee in the Senate is back. Meet Gene

    Sperling, appointed today by President Obama as Chairman of the

    National Economic Council. In exactly the same position, Mr.

    Sperling had served as the Clinton Administration's point man in

    discussions with the Republican party on immigration. Much of

    today's INA section 212(n) is Mr. Sperling's pound of flesh

    exchanged for increased H1B numbers that were the heart of ACWIA.

    Those increased numbers are long gone, but the myriad

    restrictions on H1Bs originated by Mr. Sperling remain. It is to

    Mr. Sperling that we owe the idea of using H1B fees as a milch

    cow for purposes completely divorced from H1Bs. We suspect that

    sometime during the 112th Congress, the GOP will float a bill to

    couple mandatory E-Verify to token business immigration benefits.

    In that event, it is entirely likely that the Obama

    administration will nominate Mr. Sperling to negotiate directly

    with the Republicans (bypassing all the Democratic legislators)

    for DREAM or other riders on such a bill. Of course, the Obama

    administration may well use another channel to negotiate on

    immigration legislation, or it could simply choose the path of

    confrontation with the GOP on this issue, and take its case to

    the people in 2012. However, it is undeniable that a seasoned

    negotiator, a veteran of immigration discussions, is back in the

    top executive branch ranks. Let us see what Mr. Sperling does on

    the immigration front in his second round in the job. Stay tuned!

    1. Comment: No Citizenship For America Haters - Not satisfied by

    visiting the sins of the parents upon the foreign-born children

    of the undocumented (in killing the DREAM Act), the anti-

    immigrationists are now taking aim at the American-born children

    of the undocumented. Even though this would mean throwing away

    the rule of the law - the centuries old doctrine of jus soli

    which has always been the bedrock of American citizenship - the

    anti-immigrationists are not troubled by trifles such as

    following the plain language of the constitution.

    The anti-immigrationists' fantasies rest on the belief that the

    phrase "subject to the jurisdiction thereof" in the 14th

    amendment somehow implies that the undocumented are exempt from

    the jurisdiction of US law, and therefore from the benefits of

    the 14th amendment also. In an article

    debunking this maliciously fraudulent misinterpretation of the

    14th amendment, James Ho writes:

    "A foreign national living in the United States is "subject to

    the jurisdiction thereof" because he is legally required to obey

    U.S. law. (By contrast, a foreign diplomat who travels here on

    behalf of a foreign sovereign enjoys diplomatic immunity from-and

    thus is not subject to the jurisdiction of-U.S. law.) During

    congressional debates, both proponents and opponents of the

    citizenship clause agreed with this interpretation of the 14th

    Amendment. For example, Pennsylvania Sen. Edgar Cowan opposed the

    clause precisely because it would extend birthright citizenship

    to the U.S.-born children of Chinese laborers and other

    noncitizens who "owe [the U.S.] no allegiance [and] who pretend

    to owe none." Tellingly, Cowan's racially charged opposition was

    met with the following response from California Sen. John

    Conness: "The proposition before us... relates simply in that

    respect to the children begotten of Chinese parents in

    California, and it is proposed to declare that they shall be

    citizens... I am in favor of doing so... We are entirely ready to

    accept the provision proposed in this constitutional amendment."

    The anti-immigrationists take refuge in the argument that few

    other countries scrupulously follow the jus soli doctrine,

    preferring instead the jus sanguini doctrine, the very doctrine

    that has consistently led to enormous ethnically-motivated

    bloodshed in Europe in days past, and in Africa and Asia today.

    Patently, the anti-immigrationists do not believe in American

    exceptionalism. If they don't like the US constitution, and

    prefer the doctrines of other countries instead, the anti-

    immigrationists should leave America promptly. If not,

    immigration advocates should start drafting legislative language,

    including a constitutional amendment, to deport the anti-

    immigrationists from the USA.
