Wait a second- I'm confused. The memo clearly states: "If a visa availability date regresses, and an alien has already filed a Form I-485 based on an approved ... Form I-140, the officer should retain the Form I-485 and note the date a visa number first became available." The I-485 filed herein was filed based on a pending I-140, not an approved I-140. The I-140 was later approved, after the dates had retrogressed- big difference in my book. Please explain.
