My son came here with an approved I-130 petition. Overstayed >180days. I am a legal permanent resident only. This means he cannot apply for the provisional waiver? Thanks!

USCIS recently published revised Form I-601, Application for Waiver of Grounds of Inadmissibility.

The revised Form I-601 is labeled with a Dec. 16, 2012, edition date. Form is now available for use and can be downloaded from the USCIS forms website.

Previous edition Form I-601 dated Dec. 16, 2012 will only be accepted until April 16, 2013 – 90 calendar days after publication of the revised form. After April 16, 2013, they will only accept the Dec. 16, 2012, edition for Form I-601.
