Kansas Secretary of State Kris Kobach is representing ten U.S. Immigration and Customs Enforcement officers in suing the Obama administration in an attempt to block DACA, claiming that it violates federal immigration laws. Kobach, naming Janet Napolitano and John Morton as defendants, is an adviser to Mitt Romney and co-author of Arizona S.B. 1070, and pushes for the Republican Party platform to include border fences, a national E-Verify employment system, ending in-state tuition for undocumented students, and ending sanctuary cities.
There is no debate regarding Kobach’s political stance on immigration; Napolitano and Morton are being sued by some of the most staunchly anti-immigration individuals. Kobach claims:
The Directive commands ICE officers to violate federal law, as detailed below, commands ICE officers to violate their oaths to uphold and support federal law, violates the Administrative Procedure Act, unconstitutionally usurps and encroaches upon the legislative powers of Congress, as defined in Article I of the United States Constitution, and violates the obligation of the executive branch to faithfully execute the law, as required by Article II, Section 3 of the United States Constitution.
