No Work Cards Until Initial Deferral Application Approved

They say the devil is in the details. In reviewing the USCIS announcement, the agency says applicants cannot apply for employment cards until their application is approved. But USCIS has not indicated how long such applications can take. I would urge USCIS to consider allowing employment authorization documents based on the receipt being issued for deferral rather than approval. USCIS could take months - perhaps longer than a year to work thought the applications - and delaying issuing work cards will only prolong the suffering. Please, USCIS, consider modifying that requirement.

    The devil is in the details and so far the details mirror very close to that suggested by Rubio. Looks like the intention and timing of this announcement is to outmaneurve Rubio and also prepare latino voters for a possible adverse judgement on SB1070 which is expected from the Supreme Court in the next days.

    I think these people can wait few days or may be Mr. O will introduce premium processing for these applications too . I think it will be good if the administration introduces premium processing for these applicants at a cheaper price of $50.

    Another point is that in most states people won't be able to get a DL unless they have the work permit and SS, to prove some sort of status. If they wait until deferred action is granted the problems will remain specially if the AZ law is upheld.

    That's the point. Even for identification and driving licenses DMVs want to verify your documents etc. I don't think it is unreasonable if USCIS wants to verify if an applicant qualifies for deferred action under new guidelines. Obama will speed up the process anyways to accommodate CHC before elections.

    According Pew hispanic research around 1.5 million people are eligible for this work authorization. All these applicants filing paperwork bring all the processing at USCIS to a grinding halt and it can take at least half a decade to clear this mess.
