House Passes Bill Barring White House from Suing States Over Immigration

It will go nowhere in the Senate and would obviously be vetoed, but it's one more reminder of how Congress has completely abdicated its role in immigration law. States wouldn't be legislating in immigration if Congress was actually passing the necessary reform bills.

    Would this mean that a future de facto Haley administration cannot sue California or Utah over instate tution for illegal immigration or it will only be enforced in cases such as Georgia or Arizona?

    Ironic considering the Democratic president said he had done everything he could administratively (i.e., due to the Separation of Powers doctrine) then turned around and did what he just suggested he did not have the power to do.

    If so then the courts will decide that, but given the fact that you can not count on congress to do any work on Immigration or anything else other that strict political ideology. He should do what he can administratively, that is within his power to do separation of powers or not. The repuks want Congress to have the power because they know that from now on the WH is a very long shot for them......

    I don't understand how did these guys get elected in the first place. A complete waste of time - guess they have nothing better to do anyways.

    Actually know Peri very well. I have no problem with what he suggests. Actually much better than the nonsens that Gary Becker suggested a few years ago, where only millionaires or multimillionaires could come to the US. The firm essentially decides who gets hired...if they cannot hire an immigrant here, they hire the potential immigrant in his home country or in a third country. How do you think Singapore ran up its active labor force by 100% over the last fifteen years?

    @GC - Many pro dream act alleged that Rubio's proposal would create a second class status in this country for many dreamers. What do you think this proposal is ? Have you seen the Perri's entire proposal ? I bet you will have second thoughts once you see the details.

    Ideally, that's not the way Congress should address immigration--they should make their intent clear through statute. But sometimes they do and the law is ignored. 1373(a) is perfectly clear but Obama ignored it and sued anyway. Now the Supreme Court, even Democratic nominees, are like "Why are we here?" [in light of the clear intent of 1373(a)]. Maybe it is just political theater, a waste of the court's time, and improper politicization of Justice and Congress should just let it go and wait for Obama to lose. After all, how much clearer can they get than 1373(a)?

    The intent of the IIRIRA law dealing with in-state tuition was clear--but states created proxies for residency to defeat Congress' intent and courts looked the other way. On that one, Congress could effectively tighten up the loophole.
