Why Obama Can Ignore DOMA Now Rather Than Waiting on the Courts

Houston lawyer Gary Endelman has written an excellent article making the case that a President not only can ignore carrying out laws that he or she deems unconstitutional, but that the President actually has a duty not to do so. In other words, the President is well within bounds to begin treating same sex spouses the same as heterosexual spouses when it comes to immigration applications.

    Yeah but election year politics get in the way.....he would not want to offend the "independent voters" that decide the election.

    Majority of the US population is in favor of same sex unions, and about 40% are in favor of same sex marriage, with percentages growing every month. Most independent voters have turned the corner on this issue, and they don't want it to be used to gain any political capital. The reason why Iowa's decision on same sex marriage was not challenged by a referendum was just that - it would have lost.

    I agree LNLW just saying is not a time when politicians take political risks lightly....

    The president addressed the press and said he was puzzled about why people thought that he was not a US citizen. Obama didn't dwell on the issue long, however, and said that there were more important issues for him, and the rest of the country, to tackle.
