H-1B USAGE OFF TO SLOW START

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. That's roughly the typical weekly usage we saw last year and if the pace doesn't change much, the cap will potentially be hit one to two months later than for FY2011. Later this summer as the cap starts to get a little closer to being reached, I'll start issuing projections of the dates each quota is likely to be filled.

    People with renewed petitions are thinking twice to go out of the country to get VISAs stamped.


    I think most of the Indian companies are using the L1 and B1 route to avoid the scrutiny .

    A colleague of mine went to India in Dec 2010, him and his family - wife and two US born kids - are still stuck in the 221G mess with no end in sight. The client terminated the contract, he has to keep paying his rent, bills etx. An immigrant's life is painful indeed.

    This is precisely the reason why many are going back, many are not even looking at US as an option, and the remaining are looking at either his/her home country or other countries where you don't have to wait for 20 yrs in line.

    I think the Democrats actually want this because they are pro-union. They will get the necessary votes by fooling the general public by saying that they saved some jobs that the immigrants would have taken, albeit it is a insignificant portion of the annual jobs generated every year IN the US (>2.5 million jobs). Republicans are for legal immigration, but will not do anything under the Dems watch, as they are afraid that the Dems will take credit for it. So possible sceanrios:
    1. 2012 - repubs take charge and do something in 2014.
    2. Dems still win in 2012 and no action for another 4 yrs - rest assured the 65K H-1 B jobs will be there - as legals are tired waiting for this broken system to be fixed. period.

    RIGHT.......that is why they did sooooo much when Bush was in office and they controlled everything and the economy was doing good. Blessed their hearts these republicans are just such immigrant loving bunch!!!!

    Actually, there is next to nothing Democrats have done for the unions in many-many years. Democrats use unions in elections, but then unions get nothing in return (well, I guess they don't get Wisconsin-style assault in return either).

    Hmmm... I have never heard Democrats saying that. They may say they are tryingt to save jobs from going abroad, but they NEVER bash immigrants for "taking" the jobs. That's the Tea Party storyline.

    Former Gov. Arnold Schwarzenegger leads a list of 19 so-called "stakeholders" who will meet with President Obama at the White House to discuss immigration reform Tuesday afternoon.

    New York City Mayor Michael Bloomberg, former Los Angeles police commissioner Bill Bratton, Los Angeles City Council President Eric Garcetti and former Republican Sen. Mel Martinez of Florida are also attending, the White House says.

    The Obama administration says the group will discuss "the importance of fixing the broken immigration system for our nation's 21st century economic and security needs." Other administration officials attending include U.S. Atty. Gen. Eric Holder, Homeland Security Secretary Janet Napolitano and Labor Secretary Hilda Solis.

    How immigration reform figures into the 2011 legislative agenda is unclear, but the White House says Obama "remains deeply committed to fixing the broken immigration system."

    It is clear that Barack Obama will get the necessary feedback in order to make final adjustments of what's coming next:
    The issuance of an Executive Order granting some sort of legal protection to millions of undocumented immigrants living in the United States based on certain prerequisites and requirements: most likely a renewable work permit (government benefits will be denied to those people at this time) while mandating these individuals to register in DHS database and the Selective Service System as well.

    Barack Obama says one thing and does the opposite, there are many examples in his current mandate sustaining this assertion (i.e. according to the President no US ground troops will be committed to the ongoing military campaign against the Qaddafi regime; however, NATO is already preparing a "humanitarian force" to be deployed in Libya).

    As soon as the Dollar collapses -check the price of Gold as the best indicator of this upcoming event- ordinary Americans will desperately beg for any solution, specially the so-called "Baby Boomers" (the biggest segment of the populace). This generation of Americans know very well that their retirement benefits (specifically Social Security) largely depend on the contributions made by the active workforce, thus legalizing undocumented immigrants is a logical step to follow.

    The chances that Congress passes a comprehensive immigration reform next Fiscal year are almost zero, therefore, the only solution at this point is a Presidential decree: Obama has the LEGAL AUTHORITY to proceed in such direction and Congress can do little or nothing against this executive privilege.

    White House meets lobbyists off campus

    Caught between their boss' anti-lobbyist rhetoric and the reality of governing, President Barack Obama's aides often steer meetings with lobbyists to a complex just off the White House grounds -- and several of the lobbyists involved say they believe the choice of venue is no accident.

    It allows the Obama administration to keep these lobbyist meetings shielded from public view -- and out of Secret Service logs kept on visitors to the White House and later released to the public.

    "They're doing it on the side. It's better than nothing," said immigration reform lobbyist Tamar Jacoby, who has attended meetings at the nearby Jackson Place complex and believes the undisclosed gatherings are better than none.

    One of the reasons there has not been a rush for file H1s is that while the USCIS happily takes the fees and approves the petition, the DOS issues a 221(g) and denies the stamping. This is such a scam!

    you are absolutely right. There must be something going on. I know 3 ppl who have had issues while getting there visas stamped/re-stamped in India. All direct employees - no 3rd party contractor issue or anything. Guess the message is clear to legals - we will not fix the legal immigration system for you guys - will hold it hostage to illegal issue for generations to come, and will harass you to such an extent that you voluntarily leave!
