WWII VET FIGHTS OVER HIS CITIZENSHIP

Bumping this story up from the comments. For those of you who have not heard about this, a 95 year old World War II veteran recently has been challenged on his long held belief that he's a US citizen. The story has caught fire on the web and now has more than 20,000 comments. 


While an elderly veteran may not be the typical subject of a story like this, the general storyline is not actually as rare as you might think. One of my first cases as an immigration lawyer involved a young dental school graduate who only discovered he was an illegally present immigrant when he applied for a dentist license and had to produce proof of US citizenship. His parents had to confess to him that he arrived as a baby and the family had overstayed a visitor visa for decades. I've heard similar stories from time to time over the years. Perhaps parents think they're protecting their kids by hiding the truth, but sooner or later - maybe when someone is approaching their 100th birthday or being denied their dream of becoming a dentist - the facts emerge.

    Another evidence that the immigration system in the United States is indeed a total failure.

    The following paragraph extracted from the article in question clearly reflects an egregious stupidity made only in America and also shows how ignorant and uneducated their people are:
    "Employees at the local passport office scared them, telling her father 'If he pursued it, (he could) possibly be deported or [be] at risk of losing Social Security.'"

    They want it to be a failure. Anytime a person from congress- someone claiming to work for Rep. Rene Elmers was the latest-asks me donation to fight the possibility of Sharia Law, my suggestion is that they legalize the 12 million Hispanic illegals in this country and increase the Christian population. They usually hang up the phone. The white skin worshipping pagans have one goal...to hang on to their majority as long as possible...they are scared of Hispanics and particularly Asians...pagans such as these....

    And by the way poor pagans of AZ...Arizona beat Duke, but the team was mostly non-white and most likely Russell Pearce, Joe Arapio and Jan Brewer were supporting Duke against their home team..because Duke looked more like their vision for America! Actually, should say BYU looked more like their vision for America!

    Greg, I am interested what kind of defense strategy would you have chosen if you were his lawyer. I am thinking, applying for naturalization (or does he need to apply for PR first?) is a terrible idea, since things like voting record is likely to come out, and he will definitely be subject to deportation.

    My opinion is that the only way to go is to try to prove he is a citizen by birth through his parents.

    LNLW - Potentially many options. Some are based on service to the military. Maybe the registry. Possible private bill. Maybe sponsorship by American citizen kids.
