USCIS TO COMBINE WORK AND TRAVEL DOCUMENTS IN GREEN CARD CASES

Rating: 2 votes, 5.00 average.

Some good news. USCIS has made the sensible decision to combine employment authorization documents and advance parole travel documents in adjustment of status cases into a single card. Here's the press release. Lots of questions arise and not much information is available. For example, they say that it will apply to some I-485 cases. Which ones? We'll await more information, but this is definitely encouraging.

They come with a practical sensible solution & decide it apply only for some cases. It should apply to anyone with a pending I-485.

It's a great decision as it will provide a 2 year AP for those who currently receive a 2 year EAD (savings of 1 year AP costs).

However, it requires that both EAD and AP have less than 120 days of validity left, for the applications to be filed together. For people whose AP and EAD renewal cycles are more than 3-4 months apart, they will never get this benefit, as they can never apply for renewal together.

Not true. They can wait for the AP or EAD to expire and then not renew it until they're within the timeframe to renew the other document (of course, in the meantime they'll need to use a back-up status like H-1B to work and travel).
