USCIS REPORTEDLY HOLDING UP PIERS MORGAN TAKING OVER FOR LARRY KING

The New York Post is reporting that Piers Morgan, the very British judge of America's Got Talent is having problems getting approval from USCIS to come and take over Larry King's coveted seat on CNN's prime time schedule this fall. The article raises more questions than it answers. It hints at the end that the visa category being sought is not based on extraordinary ability and it also does not say if Morgan is seeking a green card or a non-immigrant visa. It also is not clear if Morgan is actually being denied a visa to come work or if he has conditioned his accepting the deal based on his getting a green card ahead of time. Or perhaps he has a green card application in process and is trying to get that wrapped up before he enters. There are many possibilities and it's not really fair to point an accusatory finger at USCIS without at least knowing some more.

    This might play a very significant role in Immigrant community, and I totally agree with George Chell.

    As Greg mentioned its not wise to come to a conclusion as whats is the issue with the case, unless CNN and/or USCIS explains whats the matter behind.

    Either way, One more nonsense getting blown out by media, after SB 1070, this will be watched very closely.

    I am even wondering why we are hiring Brits when the Brits dont reciprocate...4,100 skilled migrants out of EU per year and perhaps only 100 Americans a year. Definitely the Brits are not going to hire US entertainers as they are not part of the skilled category. Why are we hiring Brit entertainers, tv personalities and movies actors...because they happen to be white and whiteness sells and because as a result the racist antis at FAIR and CIS are ok with it? We brought in a Brit reporter by the name of Peter Brimelow. He is nothing but trouble. He created a racist website called Vdare and wrote a bigoted book called Alien Nation and wants to keep this country white. Is this the kind of Brits we admit?

    The most curious feature about this situation is that if Mr. Morgan is applying for either an O-1 visa or an H-1B visa, CNN's petition on his behalf should be able to get an answer in two weeks after filing, under the USCIS premium processing program. Why it would need to take until the end of this year to be approved seems incomprehensible.

    Even if a petition had already been denied for some unknown reason, it could be re-filed. It is not necessary to wait for an appeal, which could take forever, to be decided. There are still plenty of H-1B visas for FT 2011, which begins on October 1, 2010, available, and there is no annual limit on O-1 visas. Nor does CNN have to show that US workers are unavailable unless (very unlikely) it is H-1B dependent.

    Which law firm is handling this case? It would be interesting to know. On the other hand, maybe it is better to worry about more important things, such as how Arizona can enforce SB 1070 when most of that law has been blocked by the court. Maybe Sheriff Joe Arpaio should change his name to Sheriff Joe Houdini.

    You are being much too kind to the INS. This is a good example of the culture of "No" that permeates this "enterprise." There is no rationale reason for them to hold up the application of an eminent journalist/tv personality. They should approve this application forthwith!

    Maybe he has a pending LPR application, and thus his O visa application is being denied (no dual intent).
