The October Visa Bulletin is a Disaster

On September 10, the State Department released the October 2012 Visa Bulletin. Considering that October marks the start of the 2013 fiscal year for the federal government, the new visa bulletin spells disaster for would-be immigrants playing by the rules.

The preference categories should move forward at least 4 weeks each month just so the lines for green cards do not keep getting longer and longer. In October, there should be a great leap forward since there are 226,000 unused family preference numbers and 144,000 unused employment preference numbers for the new year.

For instance, last year, the EB-2 numbers for China and India jumped ahead 3 months between September and October. This year, after being unavailable all summer long, the EB-2 category for China opens the new year over 2 years behind what the numbers were last April. EB-2 India, which was identical to EB-2 China in April, retrogresses 5 years in October! The family categories are also a disaster.

Unless we want to lose the services of tens of thousands of highly-educated persons who will go on to start businesses and create jobs, Congress should hurry up and pass a bill to recapture green cards lost in previous years and, at the same time, rid the system of per-country quotas.

    The whole immigration system in this country is a disaster. I'm a ROW EB3, been here 6 years, still have at least 2 until my priority date is current (assuming no retrograde and steady movement). I have bought a house, paid taxes, employed Americans and generally contributed. Meanwhile people I know marry foreigners, they are citizens within 3 years, and haven't worked a day since they've been here. Others rort the system and get in under EB1 or EB2 when they should not. Until the LEGAL immigrants get their GC's, they should not be handing out work permits or even consider amnesty for the illegals.

    No one, absolutely no one cares about the Mexican first preference (the one I am in) category has essentially been halted. I know and understand the US immigration system and know we all must follow its rules. But so far I have been waiting on a ten year line that has no chance on becoming current for at least another decade. My mom applied for me in 2001 and since that year the visa bulletin for the first presence category for unmarried sons/daughters has not moved two years in more than ten years. I turned 21 while adjusting and in the current visa quotas if you are in this category the US puts you in a decades long wait. Someone who is from say, Saudi Arabia, who is on the 4th preference category on a family based petition will get his/her green card sooner than me if they start the process in 2012; while I started the process in 2001.
    But I guess the United States is tired of seeing us Mexicans.

    For India, EB2 date will not be moved at least till April 2013. This is the agenda of USCIS to make money.
    There are 45 thousand applicants who are on EAD now. Most of them have to renew their EAD/AP by Mar/Apr 2013.
    If USCIS waits till they renew their EAD/AP, they can make around 40+ millions. This is the first benefit to US govt.
    It creates some employments also in Attorney offices. That is the second benefit for US economy !

    The immigration system in this country is a disaster. I am a line EB3, here it is 6 years, still have at least 2 until I priority date is the current (assuming no retrograde and stable movement). I have bought a house, pay tax, the United States employment and general contribution. At the same time I know to marry a foreigner, they are citizens 3 years, and not a day job, because they have been here. Others rort system and enter or EB2 EB1 down when they should not. To get their GC of legal immigrants, they should not be distributed work permit even considered illegal immigration amnesty.
