WIDOW PENALTY STRUCK DOWN BY COURTS

Rate this Entry

Woohoo!! This is wonderful news and many of you may remember my blogging on this several times in the past. 60 Minutes did a great story on this late last year. The long and short of it is that the 6th Circuit has held that a surviving spouse still is an immediate relative under the Immigration and Nationality Act. Congrats to immigration lawyer Cathy Shibley who argued the case.

It is funny that the document lists Janet Napolitano as the Appellant.

Wondering why Napolitano would not want to review all the cases against the DHS agencies and withdraw the non sensical suits that are results of the bigotry of some officials with in DHS and any that are not in line what the administration is preaching. (or) Am I just sleeping?

Dont know whether Napolitano wants to go back and run for McCain's seat. She may have to appeal to racists and bigots of which Arizona has quite a few, not just Arapaio!

This is a plain waste of taxpayers money. DHS should have learned their lesson from past decisions and should revise their internal rule based on precedents. I cannot understand why they would still insist on their own interpretation of the law when the court has ruled over and over against it. I think they just would like to get those who have no resources to fight them in a legal battle.
