SENATE ADDS ANTI-H-1B PROVISION TO STIMULUS BILL

Yesterday, the Senate passed by voice vote an amendment relating to H-1B applications by banks that received bailout money. I've prepared a detailed post about the provision, but have held off on putting it up because there was a last minute modification to the language posted online and I am still trying to get the final language. A number of web sites have been summarizing the version of the language that is posted online, but I have reason to believe the final version had significant changes. So please be patient and I'll make sure I've got the right language before I start telling folks what it means.

    Initially Mr Sanders proposed it for one year and he bragged on the floor that the is only choosing this for one year. Then I guess a new player on the anti immigration front emerged (I dont know what his record on immigration is) Mr Baucus and they held discussions and extended it to two years.

    Guess what!

    Many of those international students planning to enroll in US Business schools will go to schools such as Insead,LBS and other big name schools in Asia/pacific/canada.

    With this legislation bank's would stop hiring H1B's, Jobs would automatically go to India and other countries. Keep up the good work Congress!

    I dont think it will have an immediate impact, but as the economy recovers later this year, jobs will start moving to India and other countries.

    It may not be limited to banks, but to all companies like the automakers that receive bailout funds.

    Also, the government is guaranteeing debt through many programs, so does that qualify as a bailout? If it does, does the limitation apply to companies like GE where some subsidiaries have had their debt guaranteed by the government.

    Whatever it is, if the caps are not lifted from the current 85,000 the overall admissions under H1-B will not change as there is too much demand for H1-B and only 85,000 slots. So, I think this is an academic exercise. Unless the caps are increased (not likely) there will be no case of unused visas unlike EMB.

    This guy has posted your picture and openly challenged you. I think you should take action against such anti-immigrants and set an example so that such racists do not get encouraged. Common IT Indian worker cannot afford to sue them. But you can easily do it. What is your opinion?

    Interesting. Dont see Grassley actively lobbying for this..in fact he plans to vote against the stimilus after saying that we should train American students first...not surprising the racists at FAIR and CIS are nowhere to be seen lobbying for this..all lip service from racists Kirkorian and Stein...

    Shareholders applaud the bill as jobs move abroad looking for cheaper wages and even more Americans are unemployed as a result!

    Good luck finding work in TARP companies . They are taking money and adding them in their balance sheets to make their books look good. They aint gonna hire anyone H1B or otherwise .... They will simply outsource ...

    Mr. Sanders can ban outsourcing by TARP companies too . After that Mr. Sanders can dictate to whom these banks should be lending .

    I come from a country where most of the banks are controlled and run by State and I know how they work ...

    Comment: Good Point.

    Mr. Sanders can ban outsourcing by TARP companies too . After that Mr. Sanders can dictate to whom these banks should be lending .

    Comment: That will definitely go to WTO because it is against the rules which the US is signatory to! However, there is something called Foreign Direct Investment..under this Microsoft can lay off 2000 foreign workers, but hire them back in Canada or Singapore, and they will return to layoff more American workers telling the congress that they need to cut more! This happened in 1992 and 2003 and will happen again this year.

    What BS. May I suggest learning Econ 101...
    If a company hires an American over a better qualified foreigner, the company could be violating their obligations towards their shareholders.
    So, if this bill prevents better qualified foreigners from coming here, the companies would have the duty to their shareholders to go to where the better qualified foreigners are.
    In that case, Americans would lose twice: not only are the jobs gone, but the tax revenue as well.

    Glad everyone is agreeing with me! Never understood this nonsense about "corporations will be forced to hire Americans first and pay them higher wages if foreigners are barred," in this global economy. Actually corporations will hire foreigners abroad and this will drive down the wages even further. A lot of deluded people in America..no wonder we are in very serious trouble.

    The funny thing is Grassley voted agaisnt cloture and is going to vote against the stimilus bill, the anti h1-b provision not withstanding!

    If companies tries to outsource too much congress may bring legislation to restrict outsourcing. These Bank jobs including VP are jobs which does not require rocket science. It will be business as usual. Only potential immigrants will be impacted not the country.
