CONFIRMED: NURSING VISA BILL TO BE VOTED ON BEFORE DAY'S END

Senator Reid announced this from the Senate floor. I'll summarize the measure this evening, but it basically allocates 61,000 green cards for nurses, requires a fee of $1500 be paid to a fund for additional educational opportunities for those pursuing nursing degrees in the US and encourages nurses from developing countries with nursing shortages to return home for several years in exchange for a shorter naturalization residency period. More to follow later...

    Greg,

    Does it mean that the nurses have to go back to home country after getting the green card?? After spending thousands of dollars ???

    Pls clarify.

    Also, how will it affect nurses who have already filled their petition?

    there were two amendments, 3404 that had a nurses recapture only and no other provisions including home country stuff, and i think 3440 that had other EB recapture as well. which one will be up for a vote?

    Well I suppose it works fine if we get more nurses in this country. We EB folks will need them to nurse us back to health after the mental anxiety, stress and trauma of being trapped in this immigration system.

    I really don't support these measures. USCIS doesn't process enough applications, the EB backlog grows, greencards are thrown down the drain. Then along comes congress and robs Peter (regular EB applicants in the backlog) to pay Paul (the nurses) -- the people who are paying the price for USCIS inaction are EB applicants in the backlog! Green cards that are legitimately theirs are being given to others. It is *they* who should be given any recaptured visas. Otherwise you create perverse incentives for USCIS and Congress.

    I don't understand why Hammond Law said that the amendment was passed....it wasn't even vote upon....am I missing something?

    I'm not sure but I think it passed by voice vote. We need confirmation though.

    Shusterman has confirmed that the nursing visa amendment was attached to the Labor/HHS bill. He added that if it survives conference committee, the backlog for nurses and other Schedule A professionals will be eliminated. Hooray for nurses!!!
