Team IV has put together a video presentation laying out the case for going.

    Not spam, but something that shows a new development. Someone has taken the initiative to build a site to provide information to prospective employees on rogue employers.

    I took a look at the site and saw it was worthwhile so I deleted my comment. Good luck. But how will you prevent people from falsely reporting companies for malicious reasons? Obviously, a person with bad motives could create problems.

    Yes, that is a problem. I don't believe the owner of the site has considered that moderation will be required as it is for all online communities. But then again, if there is nothing wrong, then employers should not fear a visit from the programmer's guild or dol.

    The surprise visit isn't where the damage lies. It is the damage to their reputation by being posted on this site. In fact, I could see some unscrupulous anti-H-1B types falsely reporting companies that hire a lot of H-1Bs just to get back at them even if they're in compliance.

    The anti-H1B community can and does post defamatory content on other forums. Plus readers can separate the wheat from the chaff given enough specifics and technical detail.

    Greg, Thank you much for posting about the rally for the second time! Hopefully Congress will stir itself to look at the extent of the problem and find some common sense solutions.
    Please also post on your blog a clarification that it's perfectly legal for non citizens to go to a rally and petition government. One of the best reasons to be in the US is the right to free speech! many people appear to use this fear (real or pretend) that their green card application will be impacted- as a reason not to attend.

    Honestly, I thought the presentation is very misleading. Where all this stuff about not being able to change title or get more than 5% wage increase is coming from? IV is misleading it's own people. Not good. Not good at all.

    i'm not in the right field to answer that question, but the people who made that- they were a group of volunteers- there are alot of videos being made- are pretty reliable people, so i would personally accept what they say till proved wrong. i am told (again i don't know) that many firms will not change titles (mainly in the context of promotion) becuase LC is very specific- or they use it as an excuse- whatever the case, there are people stuck without a change of role for years. check any forum and you will hear them.
    can't comment on the wage bit- suspect again the issue is that companies use the broken system and interminable wait to exploit the worker- the wage is tied to the position and they won't allow a significant change of designation...ergo- at least i think that's what it is.
    feel free to educate....i will try get info from the horse's mouth too...

    First, this is BS, and 'many firms' argument does not prove anything, it's like saying 'many firms don't provide health insurance, so we are going to argue that health insurance is prohibited by law'. Total bullocks. For example, my salary to start with was more than 5% higher than that of LC, and I got a promotion with a change in title even before my LC was approved, and that did not impact anything. On top of that, I AC21ed to different job two levels higher with a +25% increase in earnings a year after AOS filing. Second, don't you think such organization as IV should be HELPING immigrants overcome their difficulties as opposed to scare the crappies out of them over virtually nothing?

    This approach just does not strike a good note with me.

    Paskal, to elaborate on the thought - the whole presentation assumes that the audience needs to scared into going. It assumes that these people are driven by very selfish motivation - "oh, I appled already so I dont' care" - so, let's scare them into going.

    Why not assume that people would want to go because of benevolent rather than selfish motivation? If I were close to Washington, I would certainly have gone, but not because I am afraid I'll be stuck for long (no, I am current and literally, inches from approval). I would go, because I think the system is crappy and is unfair to people - people other than me. I watched this presentation, and I thought it appealed to the worst in me (or anyone), it exaggerated the truth to find my buttons... it actually reminded me of the scare tactics of NumbersUSA - let's lie to people and scare them into political activism. This is just wrong. It is especially wrong because there is so much you can say that would move people, about their contribution to the this country, about unfairness of the whole thing, about helping fututre immigrants, that would move them to change the world for the better, at least for a small group of people. Just in general, I believe that using positive messaging ('I have a dream') is going to work better for the purposes of driving people than using negative messages ('They are all ******** racists, so we are going to come together and show them'). Am I getting there?...

    EB, are you saying "it's easy to stand on the sidelines and critisize" or are you really calling to action? If you could describe to me how exactly the presenation would be used, I could do it.

    i appreciate that thought. someone put together a video they thought was "motivating", does not have to be so for everyone and certainly does not have to be perfect. you would be more than welcome to come help make a better one- we are all volunteers frankly- there is no intention to mislead anyone-we are all in the same boat. in any case one can hardly mislead the crowd that comes on these forums- many people there know more than anyone can imagine about immigration. i was only pointing out to you that my experience on immigration forums is that a lot of people complain about not getting promotions after LC is filed. in my field i have no way of knwing anything about this.
    if you would like to help with a video that sends a positive message it would be very welcome indeed!

    ps.(or NB!) as for doing things out of benevolence or simply because you do not like unfairness, my friend you stand head and shoulders over the majority. most people prefer that others do while they watch- even when personal interests are at stake!

    Legal and waiting, I think you might be right. That video might work for only a certian group of people. I like your way of thinking:

    Oh someone already asked the person who made the video about the misleading statements on salary increases and made a suggestion for a line edit to the video.

    Of course IV's Aman Kapoor makes a similar allegation (5-10% salary increase) in this video http://www.youtube.com/watch?v=o4yTnDNF2Lc (see at min 1:37 and forward) so apparently this is not just a case of a misinformed volunteer.

    Greg Siskind, being an attorney, should be able to clear this up i.e. state clearly that there is nothing in the law preventing salary increases greater than 5%.

    L&W is going by her fortunate but atypical experience.

    I can confirm that the part about slower career growth and promotions is true. Even if the LC is very generic and does not need to be refiled, the fact remains that the employee has minimal negotiating power while his GC is pending. This is something I have experienced in the past and is also something I use wrt employees under me on advice from other managers.
