Greg Siskind on Immigration Law and Policy

THEY'RE JUST COMING FOR OUR WELFARE, DON'T YOU KNOW

Rate this Entry

In my last blog post, I mentioned that immigrants are essential to the defense of the US. Some of you may have been skeptical when I mentioned that illegally present immigrants are part of that defense infrastructure. I know from personal experience that the armed forces have many such immigrants because my firm has represented some of them. Just after publishing that post, I ran across this article on the subject. I'm not sure what else these young people need to do to prove their love for this country, but those who like to stereotype the undocumented as a lazy, criminal class really need to snap out of it.

I mentor an 18 year old illegal Latino. He, too, thinks he can just sign up with a recruiter and become "legal." I am a retired Army officer and know better, that the situation is as confused as the article presents. Signing up would require him to make a false official statement in his recruitment papers... a felony offense that probably would make it impossible for him to later receive legal status if the DREAM ACT or CIR finally is enacted.

When I questioned local Army recruiters, to their credit they said that they would have to reject him because of his immigration status. They also advised against false statements on the recruiting forms.

Thanks Whitney - It's always a bit of mystery how someone makes it in despite being out of status. In some case, it's a person presenting false papers or just lying. In others, I've had clients who actually came as children and believed their whole lives they were legally here. Social security numbers used to be easy to legally acquire up until the mid to late 90s so people often have legitimate, valid numbers that they've had since they were children. I'm sure part of the problems have come on the recruiter side as well. In any case, there are certainly many people in the armed forces without valid papers.
