IMMIGRATION VOICE REPORTS USCIS DECISION TO BE ANNOUNCED SHORTLY

I'm checking my sources as well, but IV is saying that a deal will involve something similar to, but short of, allowing adjustments to be filed when no numbers are available. A few days ago I mentioned that interim benefits like employment authorization and advance parole might be possible, but that filing an adjustment without a visa number is barred by the Immigration and Nationality Act. I'm hoping that the solution is something of that nature and that Congress will solve the problem by fixing 245(a)(3) and allow for adjustments to be filed without visa number availability.



[UPDATE]: My source confirmed a deal has basically been reached, but that a few issues are still being worked out and that something should become public very, very soon.

    Hmm. I thought numbers were available in July. If that was the case, maybe they'll accept some applications. My interpretation of the news was that they'll probably accept everything in July but that this solution won't be permanent, i.e. won't extend beyond July when numbers aren't available.

    DEAL BETWEEN WHO AND WHO?

    Greg: you say that your source mentioned that a deal has been reached. Can you please confirm whether this was between USCIS and AILF/AILA?

    Please post details whenever you can, this has us all on the edge of our seats.

    So maybe we are back to the "permanent" solution. I am still skeptical about how this would work for people on NIV's. What kind of status would be granted in this case, since no AOS would be possible. Seems like Nurses still have no way to break into the system. Health care workers are almost completely locked out of the system, even though the country is in dire need of them. I guess it's back to advocating for schedule A bridge.

    Here is my confusion. Since it's illegal to accept 485 when visa numbers are unavailable, what will happen to the applications that are filed in July but reached USCIS after the visa is depleted? I am sure even if there is some available, they will be used up very, very soon, considering how many are filling this month.

    I hope their "solution" considers this possibility.

    Greg, Is it EAD+I485+AP or just EAD+AP - I think it is the former

    Accepting I-485 and giving EAD AP AC21 does not require law change .Which is different from allocating visa number to all applied I-485 applications which surely is not possible without law change .

    Why is IV stating "The decision is not exactly what we hoped for...but close to it"?

    Unless the USCIS and the DOS let those affected and their dependents enjoy interim benefits, there is no deal on the table!!!

    Meanhile...we are all waiting for the announcement.

    accepting the 485 does not require law change- "adjusting status" is what requires availability of visa number. the accepting an application part is USCIS interpretation in CFR. but come to think of it even changing CFR means announcement, public comment etc so maybe it can't be done immediately?

    Thanks for the update. Interestingly there is nothing on AILA's website. I thought they used to get info from their inside sources.

    Well, IV did the great job if it's true.

    The top of the hour is gone, and I am still refreshing my browser like crazy to check if there in any announcement from USCIS. I am thinking this is another "rumor" like the ones that came last week.
