URGE THE SENATE TO PASS THE DREAM ACT NEXT WEEK

Will this worthy bill finally be passed? It's gotten close several times and this is the first time it has had a vote since the Democrats took over Congress. For those of you not familiar with the DREAM Act, it is a proposal to allow people who



- entered the US before age 16
- have been in the country at least five years
- have graduated high school
- have good moral character (including no criminal history)



to get a conditional green card that could be converted to an unconditional green card after attending college or serving in the military.



The bill will likely be considered for inclusion on the Defense Department Authorization bill being considered next week.



These young people deserve a shot at the American dream. If you want to blame their parents for breaking laws, so be it. But these are folks who cannot be accused of wantonly breaking US laws. Many came as babies and the only life they know is that of an American. I've had clients who grew up actually believing they were American only to discover the shocking truth when they tried to sign up for the military or get in state tuition for college. I had one client who came to the country at age four and only found out he was an illegal alien when he applied for a license to become a dentist!



Please take the time to contact your Senator and tell them to support the DREAM Act. You can find more information on this by going to the AILA advocacy page on this subject.

    Will this cover children who entered the country legally but haven't been able to get a GC due to delays in the green card process?

    I don't think this Dream Act covers children who came here legally. Again, another win-win for the illegals. Only in America.....a haven for the illegals. But nothing for legal migration.

    These people deserve a break...their life is ruined eventhough they have good background with no criminal record, no nothing but just a record of the past sins of their parents....as the bible said: "The father should not suffer for the sin of his son; nor the Son for the sin of his father"...

    These people are already American in hearts and minds; the only thing missing is the paper that will prove so....

    Every now and then the question now arises me IS it better to come over US with an illegal status and enjoy the benefits when the term comes...whatever if they take into accounts children ...ok its going to bring them a legal status Now emotionally no one is going to oppose as they are children and they do deserve a well being status among his friends and community Good for them....Its fine
    But nothing for legal.Who is going to talk for us.We are also backlogged for years.Even we deserve a confident future.Even we want to know where are we standing.

    Greg, do yuo have any update regarding the 245(i)? I have wrote several senetors, next week i will try to call either.

    FYI - You can read the bill at http://rs9.loc.gov/cgi-bin/bdquery/z?d109:SN02075: . Note that it applies to kids who entered illegally and kids who entered legally but became illegal later.

    On the 245(i) question, unfortunately I have heard nothing about this being reintroduced any time soon.

    After some encouraging posts from you with the July VB fiasco this post of yours on the DREAM act is VERY depressing. What's with you and other immigration lawyers? Why do you guys love the illegals over the legals.



    So many kids of GC legal applicants are going through hell....they are aging out with parent's GC petitions in limbo for years ...and have to apply for F-1 visa and all sorts of non-immigrant visa. They can not get in-state tuition.

    When all these things are going on how can you guys in good conscience support a bill that rewards ONLY illegals???!!!!

    So there's really 3 options for people who are here legally -

    1. Oppose this bill
    (as this will work to raise the cost of non-resident tuition paid by people who are in legal status)

    2. Stay neutral

    3. Support after adding changes so that children who are here legally also qualify

    Option 3 seems to be the most practical one.

    I am legal human. I support this bill. Illegals are humans too and need to be treated justly. I posted this on the other thread bu posting it here too because I a disgusted with immigration process. There is no human aspect to it. What about all the forefathers who came here from Europe. Were they legal or illegal aliens when they entered. Given the extent of xenophobia here, Why not build huge camps with barbed wires and put us immigrants all in there, so we can meat pack, computer program, grow produce, make clothes and all the good things which the citizenry wants for CHEAP!!!. hmmm.... sounds like someone else did this before.... wonder who. The only thing missing would be the gas chambers. or maybe they can throw in a couple of those also... just for kicks.

    I am ashamed of the decision I made to immigrate here.

    It would definitely be easier for legal immigrants to support things like the DREAM act IF it also applied to the children of legal immigrants. Having special rights for illegals that go above and beyond what those of us who have tried to stay legal qualify for is an insulting slap in the face. I support the DREAM act because it is the right thing to do, but it should be extended to the children of legal immigrants also. Many get deported because it took too long for their parents to get green cards and the children became too old to qualify as dependents. Also, still waiting for some news on schedule A bridge legislation. I know you have worked extensively with nurses and PTs in the past. Is this issue still pretty much dead in congress these days?

    And BTW, I would suggest that "PermanentSolution" might want to lighten up on the rhetoric a bit. People who blog here are all pretty smart, and you won't get very far with that kind of over the top nonsense.

    Immigration limbo, If you look carefully you will see that in reality, there is already an invisble fence for us immigrants. We can't choose the jobs we want, we cant travel freely, we cant buy houses for fear we may not get GC, we have to hold important life decisions. Now they are saying we cant marry here. Add to that some of the new H1 laws they want to pass. So the rhetoric you refer to is in a sense of reality already a GLIDED CAGE for us, not much different from a rela fence.The fence that I refered to is just an extension of our situation to illustrate what this immigration system has done for us. The Gas chambers may be taking it too far though :-) (venting of frustrations)

    A 2 year old kid was brought in to the US by his parents 20 years ago on a tourist visa....however, the parents over-stayed and so also the kid....

    they established a life, had a job...the kid went to school and was able to finish college...when he was trying to register for the board, he found out that he cannot because he doesn't have the papers to show legal presence....

    This is one of the many cases DREAM ACT is trying to resolve...America is a land of opportunity and dreams...why take away the life of the kid just because his parent committed something wrong in the past?

    I am in support of this DREAM ACT. The kid, now an adult, is an American by heart and mind...he is only lacking a piece of paper to prove so....

    The thing is: Congress is not seeing your case as a problem. You are in legal status. You are paying your taxes.

    Congress will not solve something that is not a problem to them. It may be a problem to you, but not to them.

    Don't get me wrong. I feel for you. I understand that there is inequity there. SKIL BILL is something that is for you, not the DREAM ACT.

    in anideal world all your comments would be fine. you iss the key point here: the very senators that promote the DREAM act, oppose SKIL and aything that remotely resembles it tooth and nail. Now tell me about inequity...

    Then, strive hard to lobby for SKIL BILL. You see, I know that Senators have 2 factions: the Liberals and the Conservatives....sorry, 3 factions, and the "Compromisers"....

    What I'd do is to muster people around me with similar case and then, lobby. If the illegals can lobby, why can't I, a legal?

    Equity is still there. DREAM ACT is not yet passed and so the SKIL BILL. The "compromisers" cannot make the 2 meet together in the middle. If you do not like DREAM ACT, then others do not like SKIL BILL too. So you and them have to meet in the middle...but the 'middle' is difficult to tackle....that's why many are in 'limbo'....

    This is getting difficult...if I were you, I would take up Masters or Doctoral degree to get EB2....EB3 is hard to get these days!

    you are either truly naive or pretend to be so.
    to set the record straight i have an MD and 3 board certifications and advanced training. i'm as EB2 as you can get. thanks for the advice though. EB2 india is backlogged and will be along time. as a physician i could not even apply for a GC for many years, so my PD is a joke. I have been here 11 years and a GC is many years away. Oh btw I have that masters degree already too- picked it up along the way.

    and thanks for the preaching. we have tried, and tried with SKIL, CIR you name it. visit immigrationvoice.org if you want to see a recent history of efforts. i have personally met and talked to lawmakers, called, faxed and educated staffer. so no, wise one, we are not sitting on our hands. none of this makes it fair. why can't DREAM include legal kids? why does DURBIN hate us so much and embrace the illegals? are our kids not good enough? or are our votes not enough? please stop your crap. i try having civil interaction, but your preaching is straining me to the limit.
    you defend USCIS on one thread and a DREAM purely for illegals on another. I do not know what your agenda is. But it's not the same as that of many or most here.

    Sorry, Bud! Just keep cool and everything will be fine. I know how it feels when you're falling in line while other overtake you for some reasons.
