BREAKING NEWS: USCIS EXPECTED TO BLINK, OFFER "PERMANENT" SOLUTION

I've been traveling on business today so have not been able to post as much as I would like. But a poster today asked me about a rumor regarding an imminent solution being offered on the visa bulletin mess. I have checked with a very high placed source with knowledge on what is happening behind the scenes and am told that the rumor is correct and that USCIS will very likely make an announcement either tomorrow or Monday and that, yes, the solution is expected to be one that is not a correction in the Visa Bulletin, but something of a more permanent nature. I do not have the details on what that solution would be, though I have my ideas and if it is what I'm hoping, then the news would be very good indeed. Will update as I get more news.

    Greg...thanks for the information...hoping for the best.

    Does your ideas involve accepting 485 apps, even when PD is not current...so that folks can get EAD/AP?

    Greg, what are you hoping for? Is it the same I was thinking about -- that they'd start accepting all applications regardless of priority dates, giving everybody EAD and APs, and then use the priority dates only when they need to give you the actual green card?

    By "a more permanent nature", does it mean that this solution will benefit not only people burnt by July bulletin, but also future filers?

    What is the likelihood that this solution will dismiss the lawsuits? Are those lawsuits likely to result in another non-permanent solution?

    Come on guys, I'm curious...

    I honestly don't have the answer on what the solution will be, but think the only thing that would fit the bill that wouldn't require legislative changes would be something along the lines of what you're suggesting. But I'd rather not make a prediction yet.

    The clue is in the words "permanent solution".

    This could mean one of the following or sum of all the following
    a) more visa numbers to meet the demand.
    b) Recapture the lost visa numbers and make provision that they will not loose any more visa numbers in future.
    c) People who have legally lived in United sates for 'X' number of years can apply for GC and get it in months.

    But whatever the solution be, it won't be cure all type solution.

    Increasing numbers will require a legislative change and I guess they will accept 485 applications..

    I would assume accepting I485's when PD is not current!

    An added bonus would be recapturing unused visas!

    Guys,

    My guess is, it is 485 without Visa dates being current. Now what that means is get rid of the Visa bulletin. What I am guessing is, as I can see DOS is equally or more responsible for the whole june/july fiasco. So basically some big wig politicians/government officials have decided to get rid of DOS visa bulletin.
    I hope it is true.

    I am guessing it might be that, USCIS will honor and accept all 485 applications filed in July. The priority of these applications will be maintained so that it does'nt have to be refiled again.. The medical test may be honored as well..

    Only thing, AP and EAD may not be issued until the priority date becomes current. As and when the priority date becomes current AP and EAD will be issued for those specific filers.

    This is pure speculation, but this will prevent AILA from filing a lawsuit...

    Thanks Greg- I check your site regularly. Do you recommend EB-2 Rest of World to also file this July or will EB2 Rest of World become current again in October? I was going to wait but know i am so perplexed! Any ideas? THANKS!

    This will be extremely depressing if it turns out false..i hope it is something that benefits everyone who could file in July.
    Also it is not next 24 hrs..some sites are saying possibly by Monday...

    I'm advising most clients to proceed full speed ahead in getting adjustment applications ready to file right away. And while I believe my post is correct, until an announcement is made by USCIS, they may still change their position (though I think they are really hoping to avoid hearings and responding to the three day deadline I reported earlier).

    Couple of things can happen:

    1. They pay damages that we incurred in which case we need to save all the receipts but this may run into thousands of dollars for each applicant, do they have so much money?

    2. Allocate all the visa numbers wasted so far and start using them and honor the applications.

    But we should not forget the amount of stress, difficulties that this caused to all the parties involved for the last month or more. I hope they don't do this bait and switch again to anybody.

    Greg,

    Welcome to you on IV. We all know that some thing is brewing behind scenes. I am doing my educated guess here. As your post says permanent solution, I am feeling like its more than honoring the original visa bulletin. Is USCIS working with Rep Zoe Lofgren who has been pushing them hard to get any bill that does recapture or/and ability to carry numbers forward some thing similar? I know that Sen Kennedy has also written to both secretaries even though his office chose not to make the statements official. If I am not egregiously mistaken, as per law there should be a visa number available at the time of filing of 485. How ever, I am also reading that USCIS does not need to follow DOS regulation on eligiblity of 485 filing based on a visa number availability. If that is true, I do not see a point in waiting for the VB other than for your actual green card. Its going to be an exciting day trying to figure out what the permanent solution is.
