AILF SEEKING PLAINTIFFS TO VOLUNTEER FOR SUIT OVER CUT OFF DATES

Rate this Entry

If you're upset about the OUTRAGEOUS decision of the State Department to go back on its previously released Visa Bulletin, then do something about it. Volunteer to join the American Immigration Law Foundation Lawsuit which will likely be filed in the coming days. There is no cost to participate in the law suit.  If you're interested, talk to your lawyer who can submit your information to AILF.

To be a plaintiff, you must proceed with filing your adjustment application to USCIS and then have it rejected. There may be a good reason to do this anyway because if the suit is successful, everyone who seeks to benefit from a court order may have to show they attempted to file unsuccessfully. Talk to your lawyer about this, of course, but I can tell you that at our office, we're proceeding with our applications and will file cases for clients interested in benefiting from a potential court action.  The chief risk would be spending the money on medical exams and legal fees, but obviously, again, make sure you speak to counsel.

Just had a horrible thought. You know how they have been taking steps to reduce the number of applications they would get in July by insisting that the medical be included and dropping premium processing? Maybe they just spread this rumor to scare many people away from applying, then once they get enough applications after a week or so from the ones brave enough to send them in, THEN announce retrogression again. They would process the smaller number of applications they actually do get to avoid the lawsuit. Could they be this sinister?

Greg, this is good advice. Too many people would give up and not file. For those who have not been able to complete medical exams, would you still recommnd submitting the I-485?
