1. Comment: Exiling US Citizens - Outdoing ICE agents who

wantonly detain US citizens, CBP agents are now exiling US

citizens (see an op-ed about the sad story of 4-year old Emily

from the San Francisco Chronicle).

This is what happens when too much discretion is given government

employees on issues as serious as a claim of US citizenship. Such

claims and issues related thereto should be examined by a more

rigorous process, such as before a District Court Judge. Ruben

Navarette, the award-winning journalist who wrote the op-ed

referred to above, has a long and distinguished record writing

about immigration issues. He refers to the travails of little

Emily as a deportation. The proper legal term, in our opinion, is

exile. A citizen cannot be deported, only exiled. It is the power

and process of "expedited removal" that makes such exiles

possible, and CBP has exiled dozens of US citizens since

receiving the expedited removal power. It is important to realize

that CBP did not abuse the power, abuse is inherent merely in

possessing the power - since this is too much power to leave to

the Executive Branch's discretion to exercise. Congress should

strip CBP of expedited removal authority, to restore a small dose

of sanity to our immigration system.

    Wait a minute. Re: Emily's deportation. Bear in mind that Navarrette, though he has written about immigration for years, doesn't make much effort to actually learn anything. He's a pundit, playing the outrage card, to get attention. Apparently, the grandfather, who was entrusted with the care of the child, elected to take her back to Guatemala, rather than have the parents exposed to detention and proceedings by having to reclaim the child. That's what Navarrette says. I'm an immigration lawyer, defense side, and I don't know what the government could have done any differently, unless the parents were willing to risk being put into proceedings, which, apparently, they weren't. Grandpa could have left the child, to be picked up by someone in Virginia, but he chose not to. There may be more to the story, but Navarrette didn't say it. Also, though Navarrette thinks illegal aliens have "acted irresponsibly," that's usually not true. In many, many cases, it would have been irresponsible of them NOT to take desperate measures to change their lives.
