1. Comment: 55000 EB2 Visas By Abolishing DV Lottery - GOP

Judiciary Committee member Darrell Issa has introduced a bill (

H.R. 43) to abolish the DV Lottery and move those numbers -

55,000 visas per year - to advanced degree holders of US

universities. If such a bill were to become law, this would be

welcomed by Indian and Chinese nationals who face long waiting

periods for the EB2 category. And even though Mr. Issa's bill

seeks to help holders of degrees from US universities, numbers

are numbers, and there would be more numbers available for those

who have advanced degrees from foreign universities too. To the

extent that EB2 numbers are undersubscribed, the overflow numbers

will benefit those waiting for EB3 benefits also. Our immigration

system is certainly antiquated and badly in need of reform.

Abolishing the DV lottery and the Family Based 4th preference,

and moving the numbers over to the employment side are moves in

the right direction. The reason that DV numbers and FB4 numbers

are linked is that the rationale for the DV lottery is to assist

those nations disadvantaged by "early-mover" nations in the

chain-migration phenomenon. The primary source of chain migration

is FB4, hence abolishing DV numbers is best done simultaneously.

We hasten to add that this would in no way disadvantage those

aliens who seek to come here, since it is only a fantasy of the

anti-immigrationists that immigrants come hither for welfare.

Instead, potential FB4 beneficiaries seek to come here for work,

and it makes perfect sense to have them enter through the

employment-based immigration system. The GOP will soon begin the

clamor for a mandatory E-Verify system. Clearly, some benefits

will have to be attached to a bill mandating E-Verify to have any

hope of Senate passage. DREAM is the perfect fit, and we believe

that the GOP is reconciled to having DREAM enacted, albeit with

tighter restrictions. However, it is entirely possible that the

business lobby will attempt to attach various employment-

immigration riders as soon as an E-Verify bill gathers momentum.

Mr. Issa's bill is exactly the kind of rider that would work to

add business support to a bill mandating increased burdens on

employers as to employment verification. We will know soon enough

if the Republicans simply want to make noises on American jobs or

if they are serious about moving a mandatory E-Verify bill. The

House immigration committee's schedule will reveal the

leadership's intentions - if its only a hearing, the GOP is just

scoring cheap political points, if its a markup, the Republicans

are in earnest. We will be watching, and will keep you up to date

on developments, stay tuned.

    Personally I do think giving this 55,000 annual quota green cards to employment-based Science & Medicine immigrants is better than giving DV-lottery to other lucky people just win the lottery but without any high educational qualification. Also, since international students have stayed in US for long years and they have documents such as social security no. and driver licenses' to run the comprehensive background check. Therefore, it minimizes a lot of the risk to invite the criminals to immigrate.

    However, I am curious whether this bill will be beneficial to all US advanced graduates in Science & Medicine or not. I know some new H-1B workers in those advanced degrees may NOT be the EB-type and they need to wait for certain years and then the employers will sponsor them green cards as the EB-category. And if the employers don't sponsor them green cards due to companies' merging different departments or for other accidental reason, they will lose their green cards.

    Also, some advanced graduates in Science & Medicine cannot get the H-1B working visa smoothly due to H-1B quota is full and need to leave US and some of them can't get the
    H-1B extension and need to leave US. Or some of them got laid off during their employment period due to merge of 2 companies and if they can't find another employer, they need to leave US too.

    Therefore, if they can't get into the EB category, this bill cannot help them out!! Personally I do think if to allow all those advanced graduates in Science & Medicine to enroll online by "first come, first served basis" and once the 55,000 quota is filled, then they need to wait for the next year to immigrate. This will be fair and can retain all those US advanced gradudates in Science & Medicine who are graduated in different years with different luck to get the H-1B working visa or not!!!!!!!!!!!!!
