  1. Roger Algase, Attorney at Law's Avatar
Many of my letters have been criticized as unduly alarmist, and this one will no doubt be too, but it is dangerous and foolish to underestimate the danger to American democracy and society from far right wing extremists, especially but not only in Arizona. We are in a time of severe economic anxiety, and there is more desire than ever to find scapegoats. Latino immigrants are fulfilling that function in America today, just as the Jews once did in Germany.

The "Wo sind Ihre Papiere?" Arizona immigration law at least has the pretext of claiming to be modeled after federal law, though a closer reading of the Arizona law and its legislative history show this claim to be an outrageous lie, as I have pointed out before. But no such excuse can be put forward for the latest threat by Arizona's hate filled politicians to refuse to issue birth state certificates to US born children, whatever the immigration status or citizenship of their parents. This would be in direct defiance of the US Constitution, and the modern day equivalent of firing on Fort Sumter.

Any Arizona official acting under color of law to deny a birth certificate to any child born in that state (except the child of an accredited foreign diplomat) should be prosecuted to the full extent of federal law. Then we will see some real law enforcement in Arizona.
  2. Roger Algase, Attorney at Law's Avatar
Two typographical corrections: My previous post should have said: "shows this claim", not "show this claim", and "state birth certificates", not "birth state certificates". My apologies.
  3. Roger Algase, Attorney at Law's Avatar
The June 15 cites an article that a racist city councilman and talk show host in the Great State of Aryanizona is demanding that a mural supporting green activities be repainted to lighten the skin of some children now realistically depicted in the mural as being dark, even though the children are actual students in his district, not made up figures.

So much for the argument that Aryanizona's unconstitutional immigration law which seeks to usurp federal power over immigration, its ban on teaching ethnic studies, and now, its threat to pass a law denying state birth certificates to US citizen children of immigrants who cannot show legal status, have anything to do with law enforcement as opposed to promoting hate and bigotry. Since the current state of ID's technology for this site only lets me post short comments, I will follow this one with another one directed to this last issue.
  4. Roger Algase, Attorney at Law's Avatar
What would Aryanizona possibly hope to accomplish by enacting a law purporting to deny state birth certificates to US born children of immigrants, simply because one or both parents might he illegal? As I pointed out in an ID letter last year, the Supreme Court, over 100 years ago, ruled that with only very limited exceptions such as children of accredited foreign diplomats, who are clearly not "subject to the jurisdiction of the United States", all children born in this country are US citizens at birth. The above case, Wong Kim Ark v. US, upheld the right of a US born child of Chinese immigrants to birthright citizenship under the 14th Amendment, despite the existing Chinese exclusion laws, which in effect made racial bigotry the public policy of this country at that time.

Because the above decision is so clear and has never been overturned, would not Aryanizona be wasting its time and resources trying to enact a law that so obviously conflicts with it? Not if that state is hoping that the current activist radical right Supreme Court majority might overturn this long standing precedent. Perhaps that is the gamble that the bigots in the Grand Canyon of Hate State may be contemplating.
