(a) Case: Supreme Court Says Counsel Has Obligation To Inform Of
Immigration Consequences

The Supreme Court in Padilla v. Kentucky, No. 08-651 (Mar 31,
2010), said "We granted certiorari, 555 U. S. _ (2009), to
decide whether, as a matter of federal law, Padilla's counsel had
an obligation to advise him that the offense to which he was
pleading guilty would result in his removal from this country. We
agree with Padilla that constitutionally competent counsel would
have advised him that his conviction for drug distribution made
him subject to automatic deportation. Whether he is entitled to
relief depends on whether he has been prejudiced, a matter that
we do not address.",0331-padilla.pdf

Lawrewnce W. Reed, in a typically distorted right wing attempt to compare any attempt to restore the ideal of equality of opportunity in America (which President Obama is, arguably, trying to do with health care reform) with the fall of Rome, only shows in his article (03/31/ID) that he knows more about the hogs of Rome, Georgia than he does about the history of ancient Rome itself.

Ordinary people in both the late Roman Republic and in Imperial Rome had a raw deal indeed. As Michael Parenti shows in his excellent book about the assassination of Julius Caesar (03/15/44BC), Republican Rome was ruled by an oligarchy, typified by clever politicians like Cicero (who was also a sharp and unscrupulous landlord) who looked down on the common people, many of whom were less well off than some of the millions of slaves on whom the Roman economy depended.

Julius Caesar, it is true, spent a great deal of money on the common people, somewhat in the manner of ousted Thai president Thaksin Shinawatra today, but according to the historian Suetonius, writing in the early Imperial period, Julius Caesar had enough money to bribe everyone, high and low, on his way to power.

Juvenal, writing in the same period, drew a picture of Rome so corrupt that it would have put even Enron, Abramoff and today's Republican K Street lobbyists to shame, with only a recent, RNC financed adventure in a certain California night club capable of giving early Imperial Rome any competition.

And this is without even mentioning the gladiator games, crucifixions, etc. that made both Republican and Imperial Rome a little less than enviable places to live for all except the super rich, at least by modern standards of morality and civilization.

The next time we hear about what a wonderful place ancient Rome was until it was "ruined" by the "welfare state", it would be a good idea to take that with a few grains of salt (as I am sure the Romans themselves would have done, since to the best of my knowledge, their slaves provided them with an ample supply).

The dichotomy of which the R. Algase letter complains (3/31/10 ID) regarding the L. Reed article: "The Fall Of Rome And Modern Parallels" arises from differing objectives. RA writes: "Lawrewnce(sic) W. Reed, in a typically distorted right wing attempt to compare any attempt to restore the ideal of equality of opportunity in America.." Lawrence Reed and the Founding Fathers were seeking Freedom, not Equality. While
both goals are elusive and like the stars, beyond the reach of this mortal existence, the former is morally defensible to pursue while the latter is Marxist and incompatible with freedom as coercive measures must be used to take from one to give to another to even attempt economic equality which is impossible. Governments should strive to encourage free and fair markets which results in the best allocations of goods and services possible. As stated: "FEE's mission is to offer the most consistent case for the 'first principles' of freedom: the sanctity of private property, individual liberty, the rule of law, the free market, and the moral superiority of individual choice and responsibility over coercion". The LR hog story is a simplification to illustrate a general principle. In the real world, there are those in a caring society who are deserving of some assistence. It is only when
such begins to include the undeserving that hurts US as it did Rome. Mr. Read also identifies excessive immigration and uncontrolled borders as contributing factors in Rome's decline and demise: "Immigration accelerated as people from many lands were attracted by the vibrant growth and great opportunities the Roman economy offered." (and) "But
such a claim overlooks what the Romans had done to themselves. When the Vandals, Goths, Huns and others reached Rome, many citizens actually welcomed them in the belief that anything was better than their own tax collectors and regulators. I think it is accurate to say that Rome committed suicide. First she lost her freedom, then she lost her life." It is those who place the interests and equality of non-citizens above
those of our own citizens who are contributing to America's downfall. Just ask the family of Robert Krentz who was recently killed by an illegal on his own AZ ranch or any of the 20 million unemployed Americans. See: "20 million Americans unemployed: Case for immigration moratorium" by
    Frosty Wooldridge.
