(a) 9th Circuit Says USCIS May Not Impose Novel Evidentiary
Requirements


In Kazarian v. USCIS, No. 07-56774 (9th Cir. Mar. 4, 2010), the
court said that "nothing in 8 CFR 204.5(h)(3)(vi) required a
petitioner to demonstrate the research community's reaction to
his published articles before those articles can be considered as
evidence, and neither USCIS nor an AAO may unilaterally impose
novel substantive or evidentiary requirements beyond those set
forth at 8 CFR 204.5" and further said that "while the AAO's
analysis might be relevant to a final merits determination, the
AAO may not unilaterally impose a novel evidentiary requirement."
In a footnote, the opinion said "it is distressing how many good
people - including the highly educated and the minimally educated
- fall prey to disreputable lawyers known to the immigration system."

    An editorial in the March 8 New York Times condemns Republican Senator Charles Grassley, among other right wing politicians egged on by Fox News, for attacking Department of Justice lawyers who, when they were in private practice, defended the Constitutional rights of Guantan?mo detainees, including winning a landmark Supreme Court case. Of course, the fact that a lawyer may represent an unpopular client does not mean that he or she agrees with the client's views. Therefore, nothing could be more un-American than the attacks of Grassley and his cohorts on lawyers who are carrying out the high ethical ideals that all lawyers are sworn to protect.

    It is not accidental, that Senator Grassley is also one of the leading opponents of legal immigration, especially the H-1B program. Grassley, as much as anyone else, is responsible for promoting the blatant untruths that the H-1B program depends on foreign workers' "stealing" jobs from Americans by working for lower salaries, or that the program is based on fraud. While no one would argue that there is any immigration program (or other government program of any kind) that is totally free from abuse, Grassley's wildly exaggerated claims are being taken far too seriously by DHS Secretary Janet Napolitano, who appears terrified of being accused of not being tough enough on immigration, and by Donald Neufeld and other USCIS officials who seem to be afraid that approving even the most routine skilled worker visas will be taken as a betrayal of America.

    Of course, it is a foregone conclusion that the courageous Justice Department lawyers who had upheld the highest standards of their profession while they were in private practice with some of America's best known law firms will be fired by the current spineless administration, which is desperately trying to accomplish the impossible task of passing the Fox News litmus test. But should the Obama administration also be giving in so easily to the far right anti-immigrant hate, especially against Asian and other skilled foreign workers from outside Europe, that Charles Grassley and other politicians like him have come to represent?

    If it weren't for Charles Grassley, black farmers would no now be settling their USDA discrimination cases because they would have no discrimination cases. Given this history, and a good deal more, I am gratified that Mr. Algase avoided the word "racism" which I felt sure was coming as I read, and then re-read his comment. Progress indeed.
    I don't think we'll ever all get along, but at least we are learning to talk civilly. Perhaps we even agree that we should can the H-1B program entirely and just allow a lot more legal immigration by skilled foreigners and leave the keystone semi-cops at the Department of Labor and other alphabet agencies out of the picture as much as possible. Gosh oh Golly, wouldn't that be nice? Even Senator Grassley might go along given his distaste at the serf-like status of H1B immigrants who are tied to their jobs much as the serfs of old were tied to a feudal holding unless they were sold from one to another.
