(c) Bloggings On PERM Labor Certification

Joel Stewart writes "Strictly speaking, if a Motion involves a
new analysis of an existing body of documents and data, it is a
Motion to Reconsider the existing record, while a Motion that
involves the presentation of new, previously unsubmitted
evidence, would be a Motion to Reopen."

  1. Samantha Anderson's Avatar
I commend these people for their brave acts.

  2. Malami. M's Avatar
For a couple of days I could not have access to the letters simply because you have put a web link to the letters. Make them available in the body of the mail as it is sometime back.
  3. Bruce Hake, Esq.'s Avatar
I guess the new system is easier on your nerves, but I just want to register that I'm sorry to see you dump the ImmDaily letters section. Unfortunately, I find the typeface on the blog almost unreadable, unlike almost everything else I read on the Internet.
  4. Chia-Li Sung's Avatar
It's simply laughable that organizations, advocates and whatevers just wouldn't give up mixing illegal aliens with actual immigrants. I thought you guys were competent ATTORNEYS who studied and understood what immigration laws and regulations are all about!!
Let's see, Catholic churches, in the midst of sex abuses and scandals, desperately need heavily religious but relatively ignorant illegal Latinos to fill their pews and offering plates; Large corporations need next to nothing cheap slave labor to shell out the money to pay their CEO's 300x more than their regular workers; and oh, then you have these sleezy politians who need the illegal votes from millions of illegals who mostly are illiterate.... Yeah, I can see how all of these make perfect sense for "AMERICA" to march......

  5. David D. Murray, Esq.'s Avatar
I whole heartely agree with Bruce Hake. I would rather see a Times New Roman, or similar tyeface, which is much easier to read than Ariel. However, to make it more readable as it currently is, one can click "Control +" and the size will increase every time you hit the + button. Also, I agree with Samantha Anderson, "Make them available in the body of the mail . . ." In my opinion the Letters to the Editor section, as it was before, was the heart of the publication and on slow news days, was the reason to read ID. The new Blog system is less personal and has no heart. So, have a heart, bring the old system back.
  6. David D. Murray, Esq.'s Avatar
Sorry, I meant to say I agree with Malami. M about bringing back the old format. With this new format, there is no way I can see to retract or edit the blog once it is submitted. Once there, it is there, warts and all. Sorry I gave credit to Samantha Anderson, whose comment, "I commend these people for their brave acts." I do not understand. What people and what brave acts? Now, if Samantha replies, this will become dialog, rather than dissertation. It will become a Chat Room, rather than a formal setting as was present under the old Letters to the Editor format. Credibility will be lost. But I know it will be easier on the ID Editors. However, another solution is to do what other credible publications, like the New York Times,do and that is not to accept every letter. If the letter does not meet the standard of the publication, reject it. Of course, never reject because of a difference of opinion, only on content that is rude, offensive, derrogatory, defamation and the like.
  7. Robert Yang's Avatar
It seemed that Ms. Chia forgot to mention many Taiwanese and Chinese restaurants owners who love employ cheap illegal immigrants. I am sure many of these bosses are some of her own friends or relatives here not to mention of their many American customers who love to enjoy delicious "dimsum" and Chinese food with reasonable price thanks to our "amigos" from the South and also some semi slave Chinese labor working in the kitchen despite of some their endless litany of complaints about "how bla bla bla" illegal immigrants are. Many so called "native" Americans today are nothing but descendants from illegal trespassers in the past to the native land of real American Indians just like Han Chinese in Taiwan running away and seeking refuge from Mainland Communists. Countries, not just ours are running deep into recession because of the unholy alliance and sickening conspiracies between our corrupt politicians, bankers and economy elites who try to enrich themselves by all means and tricks at the expense of the poor and the middle class.
We're engaging in two wars that we don't have money to pay for them and yet one Republican Senator from Kentucky tried to block benefits from poor and laid off Americans because he said it will add into the deficit but hypocritically supported the previous administration tax cuts to the wealthiest Americans and supported these wasteful and awful wars. It's time to end this blatant hypocrisy and stop the blame game on our fellow human beings since they just try to survive and running away from their own oppresive and corrupt regimes in their home countries.
  8. Roger Algase, Attorney at Law 's Avatar
Despite the differences in the new ID letters section format, Chia-Li Sung's immigrant bashing and Robert Yang's jabs at American citizens as descendants of illegal trespassers both indicate that the appearance of this section is likely to differ from the old one more than the content. "Plus ?a change, plus c'est la m?me chose." In all fairness, however, I have to say that Mr. Yang's comments about the corruption in America's political system and domination of every aspect of our society by the wealthy elite and their political servants are right on point.

Of the two, however, Ms. Sung's comment is more unhelpful to the cause of developing a fair and workable immigration system, because too many Americans lack the courage to stand up against the relentless demonizing and dehumanizing of non-European immigrants, regardless of whether they come from nearby Mexico or from the opposite side of the world.

As I have elaborated in another post, there are three Americans in particular who appear to lack the courage to resist going along with the anti-immigrant flow. I refer to USCIS Deputy Director of Operations Donald Neufeld, DHS Secretary Janet Napolitano and President Barack Obama.
  9. David D. Murray, Esq.'s Avatar
Robert Yang's letter is right on point. Chia-Li Sung's letter totally fails to grasp the realilties of life, as duly outlined in Mr. Yang's letter. Great job of saying it like it is, Robert, right down to the often neglected fact that Chinese business owners in America routinely violate the wage-hour laws and hire undocumented aliens without a second thought. I should know - besides immigration law, that's the type of employment litigation in which my firm routinely engages.
