(a) Dear Editor:
While not necessarily defending the decision of any particular
Consular officer or USCIS adjudicator, I would like to respond to
Pangga Philippines' letter (08/25/09 ID) which complains about
"married people being separated for a long time because people at
the USCIS take their time reviewing the documents submitted with
the petition." I believe US citizen spouse cases should take
priority at the Consulate, so as to preclude any separation of
the US citizen and alien spouse. These applications should be
adjudicated over-the-counter on an appointment basis, without the
need for stateside USCIS I-130 involvement. Then, after the
Criminal Background Check is completed, the Adjustment Package
and the alien's Passport, appropriately stamped with a Permanent
Residence Visa, should be couriered to the applicant, allowing
immediate travel to the US for adjustment of status. However,
there are regulations and operating instructions requiring basic
case documentation. These documents must clearly prove the legal
viability of the marriage, and an interview process must
determine the issue of any presumption of marriage fraud. The
burden of proof in both instances is on the alien. If the
documents submitted are not in order, the case cannot be approved
and Pangga Philippines letter's plea for Consular Officers to be
"more considerate" cannot be accommodated. The criteria for a
successful spousal application are simple, proof of identity
(Birth Certificate & Passport); proof of legal marriage (Marriage
Certificate); proof former marriages were properly dissolved
before the qualifying marriage took place (Final Judgment in
Dissolution of Marriage); and a Criminal Background Check. Voila,
a properly documented and otherwise clearly approvable Permanent
Residence Visa is normally not denied at a US Consulate. Attorney
fees in spousal cases are not excessively high and anyone filing
such an application package would be well advised to seek
competent legal counsel to avoid disappointment.

(b) Dear Editor:
The meeting with the variety of entities means one thing and that
is to see what was in the agenda in order to prepare.  The side
in favor may work for the reform and try to give idea on it.  The
ones against the reform will see how much money and time they
will need to lobby against it.  Whoever has the most skill
lobbyist is what is going to come out of this meeting.  Am I
being so negative well time will only show me if I am right or
not and if the reform will benefit the nonimmigrant at the end.
