Become The Ombudsman


Many members of the bar may be well positioned to become the next
CIS Ombudsman, but don't know the ropes about how to apply. This
fact was recently brought to our attention by the first-ever CIS
Ombudsman, Prakash Khatri, who has now returned to private
practice. The Ombudsman is an appointed, political position, not
a career civil service position. Such appointments by the
President are made by the Office of Presidential Personnel at the
White House. There is a website for applying (see here

for the mail/fax version). There are also informal guidelines in
general circulation within the Beltway on who would make a good
appointee, here are the basic requirements: The successful
applicant (1) Must be a card-carrying Democrat for at least 5 or
10 years, preferably longer (occasionally, extremely qualified
members of the other party may be appointed, but this is rare);
(2) Must be active in participating in local/state Democratic
party - this includes contributing to party fund-raisers,
volunteer work for the party, etc; (3) Must be sponsored by one
of the 3 members of their Congressional delegation, i.e.
Representative, the two Senators (since some otherwise qualified
candidates are represented by Republican representatives from
states with two Republican Senators, in these cases the sponsor
would be a Democratic representative from the applicant's state).
Many members of the immigration bar are long-time Democrats and
several would qualify based on the above 3 criteria. The CIS
Ombudsman position is co-equal with that of the USCIS Director,
within the DHS hierarchy. The organic Act creating the CIS
Ombudsman position empowers the right office-holder to really
shake things up for immigration benefits. We encourage interested
members of the bar to apply for this open political position in
the Obama administration.

religious worker petition with USCIS, may be eligible for
benefits under Ruiz-Diaz v. United States, No. C07-1881RSL (W.D.

(b) Dear Editor:
I have been in the US with an H1 and TD visa for more than 10
years. Three of my employers tried to apply for my green card,
and all  we did was to waste our time and money, without
mentioning the stress  caused by the wait. I probably have spent
around $10,000 in lawyer fees,  trying to do every according to
the law. A lot of Americans like to say that this is a country of
laws, and that  was actually one of the reasons I wanted to move
from my country of origin to the USA, among other reasons because
I always admired the system, the honesty of the vast majority of
the public servants, the  rule of law, and the civil behavior of
the people in general.  However, the immigration system is so
deficient, that I don't  feel welcome in this country anymore.
I have a friend who came to the USA illegally. Some years ago he
paid a  fine for $1,000, and got his green card two years later.
I understand that there is a humongous amounts of requests in the
BCIS,  but if they can make it any faster, they could at least
consider status  of things on the date when the documents were
filed, instead of the date  when they start processing the
documentation. For  example, the now famous "60 Minutes" case of
the widows of American  citizens. Besides the questionable and
notorious practices of removing a  widow and his/her American
children from the country, this happens in  part because the
spouses die before the process has been completed. If things
don't get better, I will have to move to  Canada. I don't want
that because my child is an American citizen, but  we may not
have an alternative.
