USCIS Still Accepting H-1B Visa Petitions Subject To The Cap!

U.S. Citizenship and Immigration Services ("USCIS") updated its announcement late yesterday regarding the number of filings for H-1B petitions for the fiscal year 2010 program under the respective caps.

As of April 9, USCIS reports to have received nearly 42,000 H-1B petitions which will count towards the regular cap of 65,000 if approved. As such, USCIS will continue to accept petitions subject to the general cap. 

Moreover, as of April 9, USCIS reports to have received approximately 20,000 petitions under the U.S. master's cap; however, it will continue to accept petitions under the U.S. master's cap as prior experience dictates that all petitions received are not necessarily approvable.

For cases filed for premium processing during the initial five-day filing window, USCIS has advised that the 15-day premium processing period began April 7. For cases filed for premium processing after the filing window, the premium processing period begins on the date USCIS takes physical possession of the petition.

Based on this updated news release, our April 8 blog post titled, "IT'S NOT TOO LATE TO FILE H-1B PETITIONS SUBJECT TO THE CAP" is still applicable.
