    12/23/2014 - Civil Action No. 2014-1966
    ARPAIO v. OBAMA et al
Doc No. 23 (memorandum opinion) by Judge Beryl A. Howell

As stated in the past, willful ignorance displayed by members of Congress, State officials and the political class while dealing with the immigration issue is an irrefutable evidence of constituents? stupidity (specifically those who are fervidly opposed to any sort of temporary relief granted by the Executive Branch to certain unlawfully present immigrants) and excoriating the current President on immigration is not going to elevate their brutish status.

Conversely, it is extremely questionable why President Obama didn't issue an Executive Order dealing with immigration under the umbrella of National Security and governed by the laws of war (it is good to remind audiences that this nation is actually in a State of War, viewed from a legal perspective). The recent "Executive Actions" on immigration are in anyway a real guarantee that these new guidelines will be fully implemented, simply because the Secretary of Homeland Security could easily postpone (and even modify or nullify) these procedures if circumstances beyond the agency's control force to take such approach (i.e. a new military conflict involving US forces, an economic collapse, a massive social unrest within United States territories, domestic insurrection, natural disasters). The assumption that immigration directives issued by DHS (i.e. Johnson memos) cannot be reviewed by the courts is vague and unfortunately, opens the door to nonsensical challenges that are indeed a true waste of time, money and resources.

Apparently Barack Obama can effectively issue an Executive Order imposing sanctions on Russia's new territories in Crimea and the Port of Sevastopol, under the umbrella of Title 50 of the United States Code (War and National Defence), but he is incapable to apply the same criteria to the immigration issue...double standards?
    Executive Order 13685 of December 19, 2014
Blocking Property Of Certain Persons And Prohibiting Certain Transactions With Respect To The Crimea Region Of Ukraine

Executive Orders dealing with National Security and issued during times of war are in most instances not reviewable by the courts.
