BIA: Detention of Children to Deter Future Migration is Not Warranted

The Board of Immigration Appeals has dismissed the Obama administration's appeal of an Immigration Judge's grant of a change in custody status concluding that "the extraordinary remedy" of holding women and children asylum seekers without bond in order to deter future waves of mass migration is unwarranted. It should be noted that this was the argument advanced by the Obama administration on appeal to justify their "no-bond" policy. Shameful.
