Section by Section Summary of Senate Immigration Bill - Title II - Legal Immigration Reform

This is my summary of the legal immigration section of Title II. The legalization and AgJobs sections are not done yet. This is the section dealing mainly with green cards. A few surprises -


Per country quotas are abolished after all


Some nice new language on the reentry bars


The welcome replacement of the green card lottery with the points system


Rollover of unused visas from year to year


The return of a much more generous V visa for family members


Raising the age to 18 for adoptions and 21 for stepchildren.


Anyway, I'm turning next to the non-immigrant visas. Enjoy.

    Hi Greg, Thanks for taking the time to summarize the long bill!

    If the bill passes what happens to the married adult sons/daughters of USC who are currently close to having their priority date become current in about 5 months and are over 31 years of age?

    I dont understand the V visa provision, should married sons get V visa and employment authorization if they already turned over 30 and I-130 FB-3(old category) petition is pending

    Or is it only available to newly filed 1A 1B 2 categories petition?

    Thanks a lot Greg for your inputs. Will a DPT (Doctor of Physical Therapy) from US be eligible for EB-1 if the CIR bill is passed. The reason I ask this is to know if having a DPT will exempt physical therapists from the visa-quota. May be be this is a way of helping out Schedule-A candidates.

    Your inputs will be greatly appreciated.

    Hi ABC - There is a provision that allows people with doctorates to be exempt from the green card caps. However, I don't think PTs will be considered STEM so the case would still be in the EB-2 category and require a labor certification. Still wrapping may hands around all of this.

    Thank you Greg for your valuable inputs. One last question - Does the criteria of the job requiring a doctorate remain the same for EB-1. In other words, will candidates having doctorates be able to file for EB-1 irrespective of the job requirement description?
