Thank you for posting helpful information on the AAO Dhanasar case. My employer submitted an NIW 140 on my behalf on 12.23 (a couple of days before the Dhanasar precedent was issued). Will all pending cases be adjudicated based on the new prongs? My petition and letters of support were structured based on the NYSDOT prongs. Am I at an increased risk for RFE/NOID since the guidelines are now different?

We are very excited to have won in-state tuition here in Georgia for DACA recipients today! We have fought for this for four years, and are excited by the victory, but tempered in our celebration because of the uncertainty of the future of the DACA program. These kids never gave up, and neither should we.

The AAO's Dhanasar NIW decision is definitely important and welcome for the small percentage of immigrants who file NIW cases each year. One can certainly understand Immigration Daily's enthusiasm over this decision, and one hopes that the decision will last beyond January 20, when our new president, if he wishes, could eliminate it (or the entire NIW) category, if he chooses) with a few pen strokes or a few new AAO appointments.
So while we celebrate this welcome, and long overdue rearranging of deck chairs on the Immigration Titanic, some of us may also wish to cast a glance or two in the direction of the iceberg which has a rendez-vous with our Immigration ship scheduled for January 20, less than three weeks from today, as this comment is written.
For those immigration advocates who believe that icebergs are at least as worthy of note as deck chairs, if not even more so, I suggest going to my two latest ilw.com blog posts:
