OH REALLY?

Gee, this is really breaking news. USCIS says that they're behind in getting receipts issued for the adjustment applications filed in July. Thanks USCIS for telling us something we didn't know. And thanks for the apology for the lousy service </sarcasm off>. Sometimes just saying you're sorry can make a huge difference in shedding a reputation for arrogance.

One sleeper issue - USCIS says they're re-allocating resources to get employment cards issued based on those applications in the 90 day time frame required under the law. But in the question on travel documents, they basically say "We'll get to it when we get to it and don't even think about traveling outside the country until then." This is the next crisis we're going to see. A lot of people adjusting don't have H-1B visas and traveling will void the adjustment applications. That means emergency parole requests all over the country (as is already seemingly happening). Expect to hear a lot about problems in this area.

If any one talks about abuse or misuse of H1B visas and for total or partial(dream act or ag jobs) "amnesty" ,I think they are just being hypocrites.

What these guys essentially say is if you are an immigrant and only do certain kind of job (even if you are totally illegal) you are welcome otherwise you are abusing the system.

Hi Sid - My take on the H-1Bs are that there are some very important enforcement provisions in the current law. If there are widespread abuses, then DOL is not doing it's job and that is what the focus should be, not passing laws that punish those abiding by the rules by taking the visa away. But the antis - MG, Roy, etc. - only provide sporadic anecdotal evidence of problems. I believe this is because the program largely functions well and the real goal is to create a scarce labor supply as opposed to ensuring US workers are employed. They KNOW the unemployment situation in IT is virtually non-existent (watch the acrobatics as they try and make you disbelieve black and white data supporting this). Or they'll try and tell you about wage suppression as if in an industry of 3,000,000 workers, 30,000 or so workers a year can have a major impact.

This is post is unrelated to the topic. I feel that much of the opposition to the H-1B program is due to the abuse by body-shoppers and consulting companies. I have a couple of questions -
1) What are the steps taken by USCIS to prevent the abuse of H-1B visas?
2) What is your take on how widespread these practices are? What do you think can be done to improve the H-1B program and prevent abuses?

Hi Greg,
I'm one of the so-called "July 2nd filer", applied for AOS and have not received the receipt or EAD yet. Tomorrow is already Oct 2, 90 days from the day USCIS physically received my application. I wonder how the 90 day EAD rule can still apply to my case.
Anyway, I read your blog (almost) everyday since I started this long painful journey to GC and all I can say is I like your "in your face" style!
