June 28 - Processing A Million Applications

Comment: Processing A Million Applications - The commotion and excitement produced by the June 15 announcement from the White House on deferred action for undocumented youth is slowly dying in mainstream media, silently falling behind the Supreme Court's decisions on the anti-immigrant SB 1070 and the Obamacare legislations. Yet the hope that this announcement ignited in undocumented youth and their families is vibrant and palpable on the ground. We have heard from many lawyers who are already receiving inquiries and getting engaged by undocumented immigrants seeking to benefit from deferred action. However, USCIS has not outlined any procedure yet to process the more than one million deferred action applications. USCIS has only stated a warning that "if you submit now, your application will be rejected" and that immigrants need to wait until August 15 to find out how to apply. We would like to suggest a solution to USCIS that can help the agency process the hundreds of thousands of applications they will be receiving very soon.

According to official sources, USCIS processes about five million applications every year, including I-130, I-140, I-145, and N-400 petitions. To process all these applications, USCIS has a staff of 18,000 members. In order to process the one million deferred action requests of eligible undocumented youth, USCIS would need to increase its staff by at least 3,000 members to complete processing in one year. How does USCIS find this additional capacity when the agency most likely does not have the authority to raise fees? With only 18,000 staff members, USCIS, which rests under the umbrella of DHS, has a pretty small staff compared to its sister agencies like TSA and CBP, which have 58,000 staff members each. With the deputation of only 3,000 CBP and TSA agents, USCIS will be able to process the one million deferred action applications. Even better, if President Obama is keen and still stands by his statement that providing an opportunity to innocent and hard-working undocumen ted youth is the right thing to do, he can depute 12,000 CBP and TSA agents to swiftly process the one million applications in only 3 months. If this option is not feasible, USCIS also has the option of deputing 8,000 Coast Guard reserve members, also part of DHS, to process these applications. The deputation of these agents will not detract CBP, TSA or the Coast Guard from their mission since reducing the nation's undocumented by a tenth is a step forward in enhancing our country's security.

USCIS has no excuses to keep delaying the processing of deferred action applications for undocumented youth. President Obama must follow through his policy announcement with concrete plans for processing a million applications, and thus show that his announcement is more than mere political posturing. Jun 26 - Grassley Makes Deal With Schumer

Comment: Grassley Makes Deal With Schumer - In news potentially bigger in impact than Mr. Obama's momentous announcement of Deferred Action for DREAMers, Sen. Grassley, Republican of Iowa (Ranking Member of the Judiciary committee), has after many years of holding up employment immigration matters in the Senate, finally made a deal with Sen. Schumer, Democrat of New York (Chairman of the Immigration Sub-committee). The compromise mandates periodic DOL audits for H1B-dependent employers with over 100 employees, and gives DOL sweeping new powers over all employers in H1B matters. In return, the per-country limits are swept-aside, with immediate positive benefits to Indian and Chinese nationals waiting for employment immigration quotas for many years. For the original amendment by Mr. Grassley, which had many provisions affecting L visas, which have been dropped from the compromise, see here. For the compromise language on H visas see here (this document, for AILA members only, is an amendment to the amendment, so it has the proposed sweeping DOL powers, but not the per-country cap elimination language).

The political significance of this compromise is considerable: Mr. Grassley and Mr. Schumer have often led their parties on immigration matters in the Senate, especially in this, the 112th Congress. Unsurprisingly, they have always disagreed, part and parcel of the grid-lock that has stymied action on immigration for several Congresses now. And that is why this compromise is significant. We believe this compromise presages many more to come, in this Congress and the next, especially on employment-immigration matters. Bits and pieces of CIR will likely come into effect, partly through the executive branch and partly through the legislative branch. Given the compromise between these antagonists, it would be a fair guess that votes exist on the Senate floor for passage, perhaps even expeditiously by unanimous consent. However, even should the Senate adopt H.R. 3012, the underlying bill, together with the compromise amendment by voice vote, it will have to return to the House, where the votes for passage are likely good.
The moving force behind the underlying bill, is a group of those affected by the enormous backlogs - a group of primarily Indian beneficiaries, Immigration Voice (this was the group that was the prime mover behind Visagate of several summers ago, when all Employment-based categories were temporarily made "current"). In their email broadcast to the world this morning advocating for H.R. 3012, as amended by the compromise, Immigration Voice attacks the immigration bar:

Unfortunately, some immigration lawyers and their advocacy groups in DC are against this amendment. We believe that this fringe group has always advocated a system where immigrants are taken advantage of. Immigration Lawyers have chosen to be on the wrong side of history. They want to protect companies that are abusing the system. This set of Immigration lawyers want to side with companies that are under-cutting US workers and committing fraud. It's time for us to standup to speak for ourselves and tell everyone that immigration lawyers don't represent immigrants. When it comes to advocacy, immigration lawyers and their groups only represent their own special interest to design the system to keep more people in limbo for longer so that they can pocket more money through renewals and extension of applications for visas and work-permits while immigrants wait forever in their green card process. A large percentage of these immigration lawyers have a vested interest in keeping the immigration process slow and confusing. They will oppose streamlining or simplifying the process that would help employers and employees. Housing market is not about realtors; housing market is about living the American Dream and home ownership. Likewise, the purpose of immigration system is not to help immigration lawyers line their pockets with more cash. Immigration system is about America, US Employers and immigrants. It's time for us to raise our voice and say it loud, that immigration lawyers or their group doesn't represent Immigrants.

We don't know what the Immigration Voice folks have been smoking, but whatever it is, it must be rather strong. H. R. 3012, as amended, would lead to increased business for the immigration bar, since the companies that DOL would target would need the assistance of the bar in complying with DOL's new requirements under DOL's new sweeping powers, so the bar cannot reasonably be viewed as having a self-serving reason were it to oppose this bill. However, to the extent that AILA has gradually morphed from being a member association into a publishing powerhouse (2/3rd of AILA's revenues come from publishing activities, not member dues), AILA has naturally distanced itself from immigrants, evidenced by the sentiment in the statement from Immigration Voice above.

To the best of our understanding, the immigration bar is divided in its view on H.R. 3012 together with the Grassley compromise. There is a faction supporting the bill since the bill would eliminate per-country quotas, the last remaining vestige of the racism of the National Origin quotas. There is another faction opposing the bill since granting DOL sweeping powers in immigration has never proven good, historically. In contrast to this disagreement, Immigration Daily emphasizes the political significance of the Grassley-Schumer compromise, in the belief that many immigration benefits locked up for years in grid-lock will now begin to flow. Comment: DREAM - Yesterday, Today and Tomorrow

In the Editorial Comment, we examine the genesis of DREAM relief, draw your attention to a new article on DREAM deferred action today by Gary Endelman and Cyrus Mehta, and point out a possible fatal problem in obtaining DREAM relief.

Genesis: Victory has many parents, while defeat is an orphan. True to this aphorism, several individuals and groups have claimed credit as instigators of the announcement of immigration relief to DREAMers by the President last Friday. In the interests of historical accuracy, we state below the two causes of the President's announcement - one of occurrence and one of substance. The announcement occurred purely as a political reaction by the President's political staff to the impending bill by Senator Rubio, Republican of Florida, which would have granted substantially the same relief, albeit through a legislative vehicle which was destined never to pass the Republican-controlled House. Such a bill would have had, by Republican calculation, a dual benefit - it would have ensured no actual benefits were delivered, since the bill would never clear the House, thus keeping intact the Republican coalition encompassing both pro-immigration and anti-immigrant elements, while still ensuring full credit to the Republican party for a novel solution on immigration matters, to the detriment of the Democratic party claim of a pro-immigrant agenda. The President's announcement completely check-mated the Republican plan, and has confounded Mr. Romney, putative Republican candidate for President, to such an extent that he continues to duck repeated questions on the merits of the President's plan for DREAMers. Now, as to the substance of the announcement. We are proud to say that the intellectual origins of deferred action as the specific legal vehicle for immigration relief, including for DREAMers, were several articles by Gary Endelman and Cyrus Mehta on the subject over the last several years, some of which are linked to in their latest article, written today, which appears below. However, the real intellectual pedigree is even older, starting with Dinesh Shenoy in his article as early as 2005 wherein he argued for a slight amendment in the INA to deal with the ever-increasing quota backlogs for Indian and Chinese employment-based adjustees. It was Gary Endelman who ran with the ball that Mr. Shenoy set in motion and first floated the original idea of using executive authority for obtaining results otherwise sought through CIR-type legislative vehicles, and it was in several articles with Cyrus Mehta that this idea was fleshed out. We have reason to believe that Mr. Endelman's and Mr. Mehta's articles were brought to the attention of two key people in the Obama administration, one at DHS, and one at the White House. These two people had key roles in producing various alternatives for the President's consideration should he make the political decision to move forward on immigration (and some of which ended up in the leaked Mayorkas memo of a couple of years ago), one of the alternatives was, of course, deferred action, which the President ultimately acted on.

New article: In their article today, Mr. Endelman and Mr. Mehta continue their ground-breaking intellectual tradition in arguing that Arrabelly and Yerrabelly type analysis be used for beneficiaries of deferred action, and for parole in place on a nunc pro tunc or retroactive basis under INA 212(d)(5) for the same beneficiaries. They further write "We want to emphasize there is nothing in the INA that prevents the immediate adoption of our recommendations just as there was nothing in the INA that prevented last Friday's memorandum" no doubt to forestall their many detractors, including the President himself, who a year ago argued that he did not have the authority which he exercised last week.

Potential Fatal Problem for Deferred Action: Be the historical record as it may, lets look forward. What would it take for DHS to deliver on the President's promises, and to go beyond the empty words that the heads of ICE, USCIS and CBP offered in a stakeholder engagement on Monday this week? The obvious elephant in the room is that it is a tall administrative duty to process nearly a million benefit applications in a few months. Many people have proposed innovative solutions, including in today's article by Mr. Endelman and Mr. Mehta, where they write: "In the absence of congressional action, the agency lacks the capacity to charge special fees for this purpose. Consequently, all relevant federal agencies, including ICE and CBP, must willingly but swiftly reassign existing personnel now devoted to less urgent tasks so that the President's initiative of last Friday does not become a dead letter." We urge our readers to use such persuasive abilities and connections that they may possess to put forth this and other creative ideas to the agencies involved so that DREAMers can realize in their own lives the dream that the President has made vivid to all Americans through his Rose Garden address.

Comment: Rubio Dream Legislation - President Obama's brilliant political move of announcing administrative relief for DREAMers has caught the Republican party flat-footed. The Miami Herald reports that Senator Rubio has been working on his version of DREAM Act for the past few months and reacted to the Presidential announcement as follows: " 'Today's announcement will be welcome news for many of these kids desperate for an answer, but it is a short term answer to a long term problem,' Rubio said shortly after Obama's announcement. Rubio also criticized Obama for 'ignoring the Constitution and going around Congress" because the executive order essentially amounts to lawmaking by the executive branch of government.' " We urge Senator Rubio to follow through with his words and actually introduce his own version of DREAM Act in the Senate providing a long term legislative solution to the problem President's executive action is addressing. Having both parties vying with each other to provide solutions for DREAMers will produce the best solution for these Americans, and will enable both parties to compete for the Latino vote. Jun 5 - Dreaming Of CIR?

Comment: Dreaming Of CIR? - We have argued for a long time that it is possible for the President to offer significant immigration relief through executive action independent of Congress. Secretary Janet Napolitano announced today that effective immediately, undocumented youth who are DREAM Act-eligible will be eligible to receive deferred action for a period of two years, subject to renewal, and will be eligible to apply for work authorization, on a case by case basis. While the details of how this initiative will be actually implemented remain to be seen, at its most optimistic interpretation, this is potentially a first step towards CIR. Jun 13 - Capping Growth

Comment: Capping Growth - USCIS announced yesterday that H-1B cap for fiscal year 2013 has been reached. June 11, 2012 was the final receipt date for new H-1B specialty occupation petitions requesting an employment start date in FY 2013. Many studies have shown that H-1B hiring is an integral part of hiring strategies of many multi-national companies. Now that an avenue of getting employees with the skills they need, here in the US, is closed to them for this fiscal year, they will need to look into expanding their workforces overseas instead. A wrong-headed policy of protecting US workers is resulting in driving of jobs overseas. The H-1b cap not only caps the aspirations of hard-working immigrants, but also the growth potential of US economy, and thereby the job prospects of US citizens.
