Hello Chris,

Thanks for the advice. We will contact the employer for a copy of the I-140 approval notice. For the mean time, I would like to ask a few follow-up questions.

Based on your experience, when will be the priority date be determined? Will it usually be the same, more or less as received date? Or is it the same as approval date? I believed that my wife's I-140 was approved 1st quarter of 2008 which is about a litte more than a year from recieved date.

Hi Ian-
It sounds like you only have a receipt notice, and not an approval notice (they are similar looking).

You should contact your I-140 employer/sponsor and see if they can give you the I-140 Approval Notice.

Hi Chris,

How are you?

I got a question. The form I-797C, Notice of Action that my wife received way back 2006 does not have a priority date indicated at the "priority date box". Only Received date and Notice date are indicated. I guess that the priority date should not be too far from the received date or notice date. Do you have any idea how to check what is the exact priority date in this case?
